Humphreys homeopathy

A federal court has preliminarily approved a $1.4 million class action lawsuit settlement between Humphreys Pharmacal and consumers who allege they were duped into purchasing the company’s homeopathic remedies based on misleading and confusing claims about their efficacy and ingredients. If you purchased a Humphreys homeopathic product within the past five years, you may be entitled to receive up to $10 cash for each eligible product you purchased.

The Humphreys homeopathic settlement will resolve a class action lawsuit, titled Nigh v. Humphreys Pharmacal Inc., et al., that alleges Humphreys and its parent company, Dickinson Brands, falsely or deceptively labeled and marketed Humphreys homeopathic products sold in the United States.

Defendants deny any wrongdoing but have established a $1.4 million class action settlement fund to pay claims to eligible Class Members. The settlement has been preliminarily approved by the court but is still subject to final court approval.

Class Members of the Humphreys class action lawsuit settlement include all U.S. consumers who purchased one of the following Humphreys homeopathic products for personal or household use from June 20, 2008 to June 29, 2013:

  • Arthritis Relief – #15
  • Bedwetting Pellets – #30
  • Cold Relief – #77
  • Cough Control – #7
  • Insomnia Relief – #40
  • Simple Diarrhea – #4
  • Simple Fever – #1
  • Simple Nervous Conditions #28
  • Simple Throat Conditions #34
  • Symptoms of Delayed Menses – #11
  • Original Teething Pellets – #3
  • Original Teething Pellets Belladonna Free #3
  • Very Berry Teething Pellets – #3
  • Very Cherry Colic Pellets – #36
  • Very Cherry Teething Pellets – #3
  • Very Cherry Teething Pellets Belladonna Free #3
  • Very Cherry Teething Strips – #3
  • Very Cherry Teething Strips Belladonna Free #3
  • Any other existing Humphreys product labeled “Homeopathic”

 

As a Class Member, you’re entitled to receive a cash payment if the settlement is approved. Class Members that can provide Proof of Purchase will receive a refund of the purchase price up to a maximum of $10 per product, subject to a cap of $100 per household. If you don’t have proof of purchase you can still submit a claim, under penalty of perjury, affirming you purchased the product(s) and receive up to $10 per product, with a cap of $50 per household.

The only way to receive a cash award from the Humphreys settlement is to submit a valid Claim Form no later than June 19, 2013.

A Final Fairness Hearing is scheduled for October 21, 2013.

UPDATE 1: A judge granted final approval to the Humphreys Pharmacal Class Action Settlement on Oct. 23, 2013. Valid claims will be paid no later than six months after the claim filing deadline, according to the Settlement Agreement.

    I loved humpherys teething pellets. I need them to come back now! Used them on my other 3 kids now I can’t on the 4th one . I don’t want to try another brand I trusted this one . My 9 month old is the worst teether yet and stupid people just want what 10 dollars give me a break . I loved these pellets for my kids I’d gladly pay 20 for a bottle I’ll swear by them.

    I was not aware of this lawsuit. I’ve always relied on Humphreys for my kids and grandkids. My mother swore by them and used the teething pellets on us! That’s how I learned about them they do work. I even used the ones for adult remedies and they also work. I hope they’re able to settle this mess and put them back in the market. I’ve been searching for them and found a similar product from Hyland which contain the same ingredients. This product can be found at Target! Walgreens and other similar stores

    I came across this because I have not been able to find the Humphreys teething tablets anywhere. I have 4 kids and this was the only product that worked for my teething infants. Unfortunately now they are not available and my poor 6 month old has to take Tylenol a lot more than I would like to give him to help him with his teething pain. I hate having to give Tylenol or any pain reliever to my baby unless absolutely necessary. The Humphreys really worked and they were natural which is way better than Tylenol. If anyone knows where or if I can find these now please let me know!

    This is ridiculous; like in any lawsuit the Lawyer is the real winner… I ended up in this page while searching for what had happen to my best friend and beloved Humphrey teething tablets; the best product to make sure my baby and I had a great nigh sleep – but I guess they fell victims of another layer and I bet a non-sense lawsuit… this is one of the reason our country is like it is; ambulance chaser looking for a quick buck and we all end up paying for it…

    That is the truth. They needed a reason to get this product off the shelves because it wasn’t pumped up with chemical ingredients like all these other OTC products put out by big pharmaceutical companies. The government is just pushing for chemical/lab manufacturered everything. Disgusting how this world is killing us all off slowly. and I can’t believe people are more interested in their measly checks than getting a great product back on the shelves. I won’t cash in on all the purchases I’ve made from the last 3 years. The company did nothing wrong but sell an awesome product THAT I SO DESPERATELY NEED AGAIN. The teething pellets really were the best stuff.

    I love Humphrey’s…their teething strips were the only thing that worked for my daughter! I HOPE they go back into production at some point.
