Humphreys homeopathy

A federal court has preliminarily approved a $1.4 million class action lawsuit settlement between Humphreys Pharmacal and consumers who allege they were duped into purchasing the company’s homeopathic remedies based on misleading and confusing claims about their efficacy and ingredients. If you purchased a Humphreys homeopathic product within the past five years, you may be entitled to receive up to $10 cash for each eligible product you purchased.

The Humphreys homeopathic settlement will resolve a class action lawsuit, titled Nigh v. Humphreys Pharmacal Inc., et al., that alleges Humphreys and its parent company, Dickinson Brands, falsely or deceptively labeled and marketed Humphreys homeopathic products sold in the United States.

Defendants deny any wrongdoing but have established a $1.4 million class action settlement fund to pay claims to eligible Class Members. The settlement has been preliminarily approved by the court but is still subject to final court approval.

Class Members of the Humphreys class action lawsuit settlement include all U.S. consumers who purchased one of the following Humphreys homeopathic products for personal or household use from June 20, 2008 to June 29, 2013:

  • Arthritis Relief – #15
  • Bedwetting Pellets – #30
  • Cold Relief – #77
  • Cough Control – #7
  • Insomnia Relief – #40
  • Simple Diarrhea – #4
  • Simple Fever – #1
  • Simple Nervous Conditions #28
  • Simple Throat Conditions #34
  • Symptoms of Delayed Menses – #11
  • Original Teething Pellets – #3
  • Original Teething Pellets Belladonna Free #3
  • Very Berry Teething Pellets – #3
  • Very Cherry Colic Pellets – #36
  • Very Cherry Teething Pellets – #3
  • Very Cherry Teething Pellets Belladonna Free #3
  • Very Cherry Teething Strips – #3
  • Very Cherry Teething Strips Belladonna Free #3
  • Any other existing Humphreys product labeled “Homeopathic”

 

As a Class Member, you’re entitled to receive a cash payment if the settlement is approved. Class Members that can provide Proof of Purchase will receive a refund of the purchase price up to a maximum of $10 per product, subject to a cap of $100 per household. If you don’t have proof of purchase you can still submit a claim, under penalty of perjury, affirming you purchased the product(s) and receive up to $10 per product, with a cap of $50 per household.

The only way to receive a cash award from the Humphreys settlement is to submit a valid Claim Form no later than June 19, 2013.

A Final Fairness Hearing is scheduled for October 21, 2013.

UPDATE 1: A judge granted final approval to the Humphreys Pharmacal Class Action Settlement on Oct. 23, 2013. Valid claims will be paid no later than six months after the claim filing deadline, according to the Settlement Agreement.

    Homeopathic remedies do work it’s not a placebo thing, that’s ludicrous. Placebos don’t work for infants. Hahaha Anyway I’m still waiting for this stupid Ponzi scheme of a suit to end so I can buy some damn teething pellets. That gel crap doesn’t work! Teething pellets were fine from the door. Come on now People!

    Homeopathic is not a scam. I’ve made my babies better and am very annoyed that I can not find the product anywhere. It’s replaced with “natural” orajel. Which we all know how NATURAL that really is

    I thinks this is a bunch of bull I have been buying humphreys for 15 years now and they have worked for me I don’t want them to send me any money I just want to be able to buy some teething pellets for they work on my kids !!! Please end the suit I am in big need !!!

    If you would like to pay $50 for a vial of water that I’ll tell you will cure your ills, then I accept PayPal. Just because it has nice packaging and a person in a white suit telling you it works, doesn’t mean to say it does.

    There’s a reason why all homeopathic remedies and clinics were closed in the UK. Think about it.

    This lawsuit doesn’t really seem legit… What is the actual reasoning behind it? My family has used humphreys products for over 60 years & we have never had a problem. They were putting benzocaine in teething gel made by Orajel & various other teething gels…. They always attack the companies that use homeopathics. If it ain’t broke don’t fix it! So disappointed that because of someone with too much time on their hands I have to wait to purchase humphreys.

      I hear you. I need #3 for teething that we have used for every baby in our family. Never knew my babys wore teething until they bit my fingers and I felt a tooth. Now I have another baby and I’m going crazy without it!
