Homeowners have requested Class certification in a lawsuit claiming that CertainTeed shingles are defective and the company does not compensate many consumers for problems they experience with the products.

Last week, homeowners Paula and Joel Wetzel requested Class certification arguing that they and at least 1,000 other consumers have been financially injured by CertainTeed.

They seek to represent people who own homes in Washington that are fitted with CertainTeed Landmark 30 shingles that were made in Portland, Ore., between Jan. 1, 2004 and June 30, 2007.

The homeowners claim that the company makes defective asphalt shingles, and when consumers experience problems with the products, does not honor warranty claims.

Allegedly, the shingles’ warranty only covers first and second generation homeowners, leaving other homeowners to cover the damage from defective shingles.

The CertainTeed class action says the Wetzels had to spend more than $13,000 to repair the roof on a their home that was made in 2006.

Allegedly, the shingles on the roof failed prematurely. The Wetzels claim that their home was fitted with CertainTeed Landmark 30 shingles, which are advertised to last 30 years.

The CertainTeed shingles class action says the Wetzels chose their home because they did not want to spend time and money on extensive repairs, but were forced to do so much sooner than anticipated because their shingles began to fall apart.

They claim that as is the case in most asphalt shingles, their shingles had asphalt granules embedded in the surface. Allegedly, these granules are supposed to function to protect the shingles from weather conditions including ultraviolet light, and when the granules loosen, the shingles degrade much faster than they should, can cause the roof to leak, and can then require  the shingles to be replaced.

Allegedly, the granules in the Wetzels’ roof loosened and fell off, clogging their gutters and decreasing the functionality of the shingles.

The CertainTeed class action lawsuit claims that around the same time, the Wetzels noticed that many of their neighbors were experiencing the same problem, and that the neighbors had their roofs replaced with CertainTeed Landmark 30 shingles around the same time.

CertainTeed, the company that makes the shingles in question, is a subsidiary of Compagnie de Saint-Gobain SA, a construction materials manufacturer based in Paris.

CertainFeed has admitted that Landmark 30 shingles produced in Portland between 2004 and 2007 possess a manufacturing defect that causes the granules to loosen and fall off quickly, well before the advertised 30-year mark.

The CertainTeed roof shingles defect class action lawsuit claims that though the company acknowledged the problem, investigated the issue around 2013, and changed its manufacturing protocol to prevent the problem from recurring in future shingles, the company did not honor the warranty of customers who had purchased the affected shingles made between 2004 and 2007.

Allegedly, this is because the company’s warranty only covers the original homeowner who had the shingles installed, and the homeowner after them. Any “third generation” homeowners or later are not covered by the warranty.

However, the Wetzels claim that many third generation homeowners experience the defect and deserve compensation.

The Wetzels are represented by Beth E. Terell, Adrienne D. McEntee, Eric R. Nusser, and Benjamin M. Drachler of Terrell Marshall Law Group PLLC, and by Catherine J. Fleming of Fleming Law Firm PLLC.

The CertainTeed Shingles Defect Class Action Lawsuit is Paula Wetzel, et al. v. CertainTeed Corporation, Case No. 2:16-cv-01160-RAJ, in the U.S. District Court Western District of Washington.

I am a third owner of my home and was told this week that my roof needs replacement due to CertainTeed shingles. My home was built in 2007 in Star. Idaho. My insurance company claim agent told me exactly what you all have shared. I am interested in any class action and believe I may have neighbors in the same situation.

  2. Dan West says:

Built our home in 2006 and used Landmark CertainTeed shingles that were produced in Portland, Oregon. I have had to clean our gutters regulatory due to excessive granule loss. I noticed this happening within the first year and thought that was normal for a new roof. Now I can see a big part of our roof has mostly bare shingles. Please help!

  3. Randy says:

Yup, same thing here. Discovered a leak last week. Both roofers we’ve had look have said our roof looks like it’s 50 years old. It was installed in 03.

  4. Robert Harper says:

Looks like I have the same problem mentioned by many of you. I live in Oklahoma and my residential roof was replaced in October 2008 using Certainteed Landmark Series shingles. I contacted my roofer and insurance company after noticing granules in my gutters and many “spots” and “streaks” on the shingles that were missing granules. The insurance company and roofer later determined that the shingles had manufacturing defects. I received a letter to that effect from my insurer. Sounds like it will be difficult to get Certainteed to make good on this. I am in the process of submitting a claim but Certainteed’s warranty claim process looks (purposely) very complicated.

The claim is beyond crazy. We have to hire a roofer to come out and take a whole shingle off our house and then send it in. Very frustrated!!!

  5. Dawn Parkin says:

Hi, we built in 2006 and just got a leak in our roof. We had three different roofers come and they all said our singles were shot. We were quoted $19,000 and were absolutely devastated that our 12 year old roof would need replaced. This is a huge financial burden. After contacting our builder we found out about all of the other issues. Are we to late because of the warranty to file a claim? Thank you for any advice!!!!

Hello, during remodel of our garage (10/2005) and remodel of house in (5/2006); both were roofed using Certainteed Landmark Pro shingles. House roof started leaking 12/2017. We had numerous roofers (giving bids) and they stated that our roof failure was due to mineral granule loss. They commented that it appeared to be 25+ years old, and shocked to find out it was less than 12 years. House roof replacement costs was $14,600.00 and our detached garage is in same condition, and needs immediate replacement also. Would like to join any Class Action Lawsuit pertaining to this issue?

      1. Dawn says:

Possibly!!!!! I’m in process of filing a claim. I will let you know what I find out.

Has this action been started we have a townhouse complex 78 units with landmark shingles they have failed degradation. They have agreed to give us new shingles but we still have to pay 600000$ for tear off and install plus little extras the roof is 12 years old.. I would love to be a part of this we think they should pay it all 78 low income families

  7. Karen says:

I built my house in 2003 and we used the same Landmark product. Fileed a claim with Certainteed as the house was built in NY and they offered 600$ compensation for the problem. If I signed the paperwork agreeing to this I could no longer pursue action. Needless to say I did not sign off on this as the bill to replace the shingles with a contractor was $12,000. How is it you would pro rate my cost of shingles but I am now responsible for the costs of removing your faulty shingles and putting a new roof on. They are aware of the problem and are compensating original owners pennies on the dollar to appease them.

  8. Parker Rieckelman says:

My wife and I are the 2nd owners of our home and when trying to sell it, the inspector informed us of our defective CertainTeed shingles. How do we track this case and get involved. We are having to replace the roof for $10k! We need help!

  9. Erik Swenningson says:

Does Anyone know if this has been certified yet or if people can join it as a class action? I have the same brand, make and year of install of shingles and the same thing is happening.

  10. Anita Ward says:

Is there a class action lawsuit my home was built in 2006 and I am having problems with the granules coming off and plugging my gutters. I need help in what I can do
