Road tollWhen driving on many toll roads throughout Delaware and surrounding states, it’s very common to use EZPass. EZPass is an automatic way to pass through the toll assessment stations throughout Delaware and have the money owed be deducted from an account.

However, a growing number of people allege that their Delaware toll violation notices are inaccurate or assess unreasonable fees.

Those drivers may even be able to participate in a class action lawsuit investigation. If you were assessed an excessive EZPass toll violation over the course of the past four years, you may be eligible to pursue legal action against the company.

Drivers pay tolls to move through certain highways. The EZPass system is often used to allow people to pass through the toll assessment stations more quickly. A Delaware toll violation may be assessed if a person does not have enough funds on their account to cover the toll that is due.

Automated toll fee collection is a way to easily and quickly pay toll fees without actually having to stop at the booth. A driver will avoid a Delaware toll violation by purchasing an account through a provider such as EZPass. A transponder is then affixed to the driver’s windshield and then this communicates with the system as the driver passes through the toll booth.

Drivers must add money to their toll collection accounts and the toll fee will then be removed from the account each time that the driver passes through a toll area.

A driver can be assessed a Delaware toll violation if they do not have sufficient money in their account. However, drivers now argue that their Delaware toll violation notices indicate much higher penalties than the base toll fee.

A growing number of class action lawsuits have been associated with problems alleged by drivers, including those who have received notice of a Delaware toll violation.

In some of these instances, the cost for the Delaware toll violation may be ten times as much as the actual toll cost for driving on the road that other drivers paid for with cash or if they had sufficient funds on their account.

If you have already been assessed an EZPass toll violation fee, you may be eligible to participate in a class action lawsuit investigation. Consumers are getting increasingly frustrated with receiving these notices and not being informed about the high penalties associated with having insufficient funds on the account.

Although the EZPass transponder and other similar services may be a seamless way to pay your toll, it could lead to more trouble if you are not careful enough to monitor the funds inside your account and if you are assessed a costly Delaware toll violation.

    Same here – $4 toll my son did not pay turned into $54 fine. I did appeal but they say I did not provide sufficient evidence. How could this be allowed? My son said he did not even know when this happened – Is it for travelling in a toll lane or not paying toll at the toll kiosk. No idea – such a scam!

    This is ridiculous! My daughter thought you could go through a toll and they would mail you a bill, she didn’t have exact change and said that was all the booth would accept. In Maryland, you just get a bill for the amount of the toll. A $4 toll and they are charging $54.00?? I was going to appeal this but it’s due tomorrow, I just received it today, the post mark is October 19. Seems they have me right where they want me. I called customer service and the recording states they have a heavy call volume, call back later. I went ahead and paid it because I can’t imagine what I would be charged if it was late, even though it would not have been my fault. It looks like possibly they could charge you an additional $87. Is there a class action opened?

      I hear you, Deborah. Got my notice for $54 on 10/22 and it’s due 10/23! But there is hope. I got in touch with a customer service rep at DelDot who said that there is a 10-day grace period from the due date listed on the notice. So you may still have time to appeal. SHe said to fill out the appeal on the back of the notice and mail it in with a check made out for $4. I hope this helps!

    My Son missed a $.25 toll and was charged $50 dollars in fees. This is the new meaning to highway robbery. I can see an administrative fee but an Ambulance Co fee and Combat Violent Crime fee? Really, we pay enough fees and taxes in the State of VA, why do we have to pay those fees to drive through DE. How do you sign up for a Class Action Suit?

      Hi Becky, if it’s still within 10 days of your violation due date, try to appeal. I called DelDot customer service and found out you have a 10-day grace period from the due date. I was told to fill out the appeal and mail it in with a check for $4.

    Yes i missed one toll in Philadelphia and expected the bill to come in and paid it. Then over a month later deleware claims a toll was missed there and wanted 60 dollars for a 4 dollar toll. Then a month after i get another bill saying we missed a different toll. I missed no toll there and refuse to pay now 100 dollars per 4 dollar toll they claim was missed. How can i even prove innocence.

    I too got the $54 charge. What a ripoff. Plus the “violation” was mid July, I got the notice on October 3rd, and payment was due October 4th. How embarrassing for them.

    I took a trip from NJ to VA and my EZ pass worked fine except the Newark Delaware EZ Pass. Their transponder obviously malfunctioned.I too got the bill for 54.00 dollars. I called EZ Pass and went
    up to the supervisor and she just yelled at me for enquiring. said i was wasting her time and that She wouldn’t do anything for me. She said fill out an Appeal. Horrid individual. the right person for the job. This is obvious case of the Corporate America/Government robbing the people. When I asked the Supervisor how many calls she received per day for this same thing, she refused to answer. Is this not public record? Pretty good gig though, your equipment “fails” so you can charge people more. EZ pass should be abolished entirely. all scumbags running it.

    I dropped .50 in the basket in the unmanned booth i guess i was to fast for the for the computer to compute the charge fine of $50.50 i’m appealing what a scam

      This is the exact same thing that happened to me…I got two invioices for times within 15 minutes of each other…this happened March 2020…a post says ez pass and then no posting I am somewhere in a toll lane no booth attendant..
      I know a camera can take my license and I wind up with a 50.50 bill for a .50 toll…no notice I was on a pay toll road…I was in the area for a funeral … What Delaware is doing is extortion …
      because the amount of money collected like this is ridiculous.

    I am currently being assessed $1026.25 for violations in 2013, 2014, of which, I had a NJ EZpass account. I have since switched to a Maryland account to take advantage of the bay bridge commuter toll.

    I had no clue of any violations until I went to re-register my RV in January, apparently DELDOT and MVC have worked a deal to lock registration until which time payment is made in full.

    I have had the knowledge from the MVC that PAM is the accounts firm whom acquired my ‘debt’ and PAM states that appeals time has expired.

    Checking with DELDOT (where the violations took place), NJ-EZ Pass (administrator of my account at the time of alleged violations), as well as Maryland EX-Pass (administrator of my current account), none of which have any dead-line for an appeals to violation.

    At all times, my NJ and MD accounts have been ‘auto draft’. It seems that from what I can see, NJ had not remitted payment to DE at the times of the crossings, and NJ had indeed closed my account in ‘good standing’.

    I offered PAM to pay all tolls (13ish) 200% of toll value, plus a one time penalty, they refused offer.

    Same here. I have an for the Delaware memorial bridge. I always checked my account to make sure there is enough money before driving on route 1. I have received several violations and have provided proof that there was enough money in my account at the time of the violation. Delaware ezpass responded back to me apologizing for the inconvenience they may have caused me. I have 10 letters of apologies. I believe this was not a mistake. It is a scam. How could this happen 10 times.. Right now my registration is on HOLD for thee amount $2, 970.00. I can’t drive my vehicle. I do not have any transportation to move around or go to work. Please help. I am not alone.. I requested my ezpass activity statements from NJEZPASS from 2013 thru 2017. Unfortunately they responded back to stating they no longer have any record. They can only provide 1 year record of my EZPASS activity. Sad. HELP, HELP HELP!!!!

    I just have received a violation bill of $91.50 for a trip 7 months in past! I can’t even remember any violations since I paid the toll charges in cash in all toll booths. There is no break up of the actual fee or administrative fee!! This is ridiculous!

      Me too! I got a $4.00 toll fee (Don’t know WHY, I never ever try to run through them as they alleged) and they added a $25 admin fee, $10 ambulance fund, and a $15 combat violent crimes fee! So a $54 charge? I tried to dispute and appeal, but they didn’t agree with me. CRAZY!
