Road tollWhen driving on many toll roads throughout Delaware and surrounding states, it’s very common to use EZPass. EZPass is an automatic way to pass through the toll assessment stations throughout Delaware and have the money owed be deducted from an account.

However, a growing number of people allege that their Delaware toll violation notices are inaccurate or assess unreasonable fees.

Those drivers may even be able to participate in a class action lawsuit investigation. If you were assessed an excessive EZPass toll violation over the course of the past four years, you may be eligible to pursue legal action against the company.

Drivers pay tolls to move through certain highways. The EZPass system is often used to allow people to pass through the toll assessment stations more quickly. A Delaware toll violation may be assessed if a person does not have enough funds on their account to cover the toll that is due.

Automated toll fee collection is a way to easily and quickly pay toll fees without actually having to stop at the booth. A driver will avoid a Delaware toll violation by purchasing an account through a provider such as EZPass. A transponder is then affixed to the driver’s windshield and then this communicates with the system as the driver passes through the toll booth.

Drivers must add money to their toll collection accounts and the toll fee will then be removed from the account each time that the driver passes through a toll area.

A driver can be assessed a Delaware toll violation if they do not have sufficient money in their account. However, drivers now argue that their Delaware toll violation notices indicate much higher penalties than the base toll fee.

A growing number of class action lawsuits have been associated with problems alleged by drivers, including those who have received notice of a Delaware toll violation.

In some of these instances, the cost for the Delaware toll violation may be ten times as much as the actual toll cost for driving on the road that other drivers paid for with cash or if they had sufficient funds on their account.

If you have already been assessed an EZPass toll violation fee, you may be eligible to participate in a class action lawsuit investigation. Consumers are getting increasingly frustrated with receiving these notices and not being informed about the high penalties associated with having insufficient funds on the account.

    Received a $54.00 bill for a $4.00 toll that I supposedly missed in Newark Del., on 95. Checked my ez pzss statement for the month and I saw that I was billed and paid thru NJ EzPass. Sent the statement along with the violatiobn notice and received a notice all was forgiven. ( Like I did something wrong) . I just received another violation for the same amount, and location and lane number. Checked my current statement and found I was charged and paid the toll. Sounds like a racket. How many just pay and don’t check. Its bullshit.

    My wife was fined 750 dollars because he car broke down and she had to use my car and never registered my vehicle to EZ pass and ran 6 tolls by mistake. I am a state worker, the State has all my information and address but never reached out to me about the violations. After a year Ezpass sent the fines to collections who were able to contact me in less than three days. They told me i owed 750 dollars, which was over a 100 dollars per 1 dollar toll ran. After arguing with them for days, they finally held my credit score hostage and said that if we didnt pay the fine our credit would be ruined and after another year the fines would increase to a 1000 dollars a toll and we would owe over 6000 dollars. The state of Delaware did not notifie or attempt to find us on purpose to charge us insane fees to line their pockets. This is legit highway robbery.

    I was fined $50.00 for a .50 cent toll in Delaware. Unmanned booth and I had no change. I assumed I would be billed. No – Fined

    It seems that I’m not alone. Drove from DC to New York and got the $4-toll-$50-fee violation notice. Other states may have such penalties as well but in a reasonable range (tens of cents or less than $2), This is the most ridiculous fee I’ve never seen; it is even impossible in other developing countries. It would be a shame.

    I owe 11k due to fees and was only notified now that I am trying to renew my registration. Losing my tag and can’t register a vehicle to even go to work now. No one wants to help just passing the buck between agencies. I am a current and up to date ezpass customers since 2003! Please add me to any class action pending in Delaware.

    $91 for a $4 toll. They sent me a final notice but never a first notice. Never. Ridiculous.

      Same here drove up to home state NJ. Hit toll booth and tried t pay with credit or debit card. Advised by attendant they didn’t take cards and I would be receiving invoice in mail. Trip was in June 2018, just received on January 26, 2019 notice from collection agency I need to pay $91.50.

      Quite a racket. I will obviously dispute. No previous invoices received.

    # toll Violations of $54 $65 & $54 with the same time stamp, same photo was used for all three.
