More and more consumers are coming forward with stories of unfair or deceptive overdraft fees and policies from banks all across the country that have led to excessive or unnecessary costs. A number of banks are currently under investigation for their potential use of unfair or deceptive practices in their overdraft programs.
If you have been affected by an unfair Capital One overdraft policy that has led to financial harm, you may be able to file a lawsuit.
Overdraft Protection
Overdraft protection programs are now a common feature of banks and credit unions alike. They can, for some consumers, be helpful, saving them from hitting the bottom of their account when making a transaction. However, some financial institutions reportedly use these programs to take advantage of their customers, wringing out as much money as they can.
Overdraft protection offers customers the ability to have money transferred to cover their transactions when they otherwise would have emptied their account; this is in exchange for a set overdraft fee. The average fee is roughly $31, though many banks charge more.
It’s not just certain excessive fees that can cause problems for customers, however. Some overdraft practices can be used to manipulate consumers or even charge extra fees.
One problem for many is that overdraft fees compound, meaning that a consumer may not be facing just one fee at a time, but many piled on top of each other. Once someone has overdrawn their account, any additional transaction on an overdrawn account will add its own charges – the cost of the item and the bank fee.
Some consumers may not have been given adequate warning about the overdraft program and its related fees when they signed up for an account, and some banks may even use deceptive practices to get customers to pay even more in overdraft fees than strictly necessary.
Several banks and credit unions are currently under investigation for deceptive overdraft protection policies, and others yet to be discovered may be using these practices.
Deceptive Overdraft Practices
Overdraft programs bring in billions to banks every year, and some financial institutions may be pushing outside the realm of legality in order to ensure their programs continue to be lucrative.
There are a few potential problems that may obscure Capital One overdraft policy or policies with another bank. For instance, when customers sign up for an account, they may not be told all the details of the program or its associated fees. Others may not be informed that they have the ability to opt out of the overdraft protection program.
One practice that can be used to collect more overdraft fees from customers is reordering transactions. Banks can deliberately skew the order of customers’ transactions to incur the most fees possible.
Filing a Lawsuit Over Questionable Overdraft Fees
Customers generally expect that their transactions will be processed chronologically, in the order they are made. However, some banks may purposely re-order a customer’s transactions from highest to lowest amount rather than from first to last, making each transaction increasingly more likely to overdraw an account.
Reordered charges means that a large fee processed earlier can tip a customer to overdraw their account earlier, with even more transactions left to be charged additional overdraft fees, leaving customers with a much heftier charge than they expected.
Some customers who have been affected by deceptive overdraft practices have begun filing lawsuits against their banks and credit unions. If you have been subjected to unfair Capital One overdraft policy or deceptive practices at another financial institution, you may be able to join a class action overdraft fees lawsuit.
