Harbor Freight unsolicited text messages class action lawsuit overview:

Harbor Freight Tools violates privacy law by sending unsolicited text messages to consumers without first receiving their express written consent, a new class action lawsuit alleges.
Plaintiff William Isaacs claims Harbor Freight violates the Florida Telephone Solicitation Act by allegedly sending the unsolicited text messages.
Isaacs further claims Harbor Freight engages in telemarketing without the policies, procedures and training as required by the Telephone Consumer Protection Act (TCPA).
“Defendant’s telephonic sales calls have caused Plaintiff and the Class members harm, including violations of their statutory rights, statutory damages, annoyance, nuisance and invasion of their privacy,” the Harbor Freight class action states.
Harbor Freight class action alleges company did not provide opt-out instruction
Isaacs claims that, starting around May, Harbor Freight began sending him unsolicited text messages where they did not identify the name of the individual caller or a telephone number or address where they could be contacted.
Further, Isaacs argues Harbor Freight did not provide him with instructions on how to opt out of receiving the unsolicited text messages and unlawfully used an automated text message system to send them.
Isaacs demands a jury trial and requests injunctive and declaratory relief along with statutory damages for himself and all class members.
He wants to represent a nationwide class of individuals who have received two or more unsolicited text messages from Harbor Freight within a 12-month period in the last four years.
Isaacs also wants to represent a nationwide class of consumers who received a sales call from Harbor Freight where the caller did not identify themselves or their business, along with a Florida subclass of individuals whom Harbor Freight has sent a telephonic sales call.
Harbor Freight Tools was in the news in February after it issued a recall for 478,800 of its Pittsburgh Automotive brand roller seats over concerns a manufacturing defect could cause them to break.
