TaurusGun maker Forjas Taurus SA has agreed to a $30 million class action settlement with plaintiffs who claim that some of their handguns are made with defective safeties that are capable of firing when dropped — even when the safety is locked.

The Brazilian gun manufacturer will give class members extended warranties, training and $30 million to settle the allegations made in the class action lawsuit.

Plaintiff Chris Carter and Taurus have filed a joint motion asking for preliminary approval of the class action settlement in a Florida federal court.

While Taurus continues to deny any wrongdoing, the company has agreed to pay Class Members up to $200 for pistols that were returned in addition to an enhanced lifetime warranty and training for the firearms.

This Taurus class action lawsuit affects nine handgun models that includes six PT Millennium models.

The $200 is based on fewer than 10,000 guns being returned. The minimum that class members will receive is $150, if 200,000 claims are filed. Taurus will also pay $9 million in attorneys’ fees.

The training Class Members will receive is for the purpose of addressing the alleged defects, which will cover basic handling instructions for pistols. The pistols which are at issue in the class action lawsuit may also receive a free inspection by Taurus under the new warranty terms, according to the firearms class action settlement agreement.

Carter alleged in his class action lawsuit that the Taurus pistols in question “contain a drop-fire defect that may cause the pistols to fire when dropped from a normal height, and a false safety defect which allows the pistols to unintentionally fire even when the manual safety lever in in the ‘on’ or ‘safe’ position and the trigger moves rearward.”

Carter is a deputy for the Scott County, Iowa, sheriff’s department. He filed the class action lawsuit after his own Taurus gun fired while he was working one day as a narcotics agent and he dropped his gun on the ground in the middle of a pursuit. When the gun fell, it fired even though the safety was on. However, no one was shot, only a car was hit.

According to the class action lawsuit, Taurus was aware of the defects in their guns since 2007. In addition, the class action lawsuit also cited lawsuits that Taurus settled over injuries that allegedly occurred from unintended discharges. Also, the Sao Paulo State Military Police in Brazil reportedly recalled 98,000 Taurus firearms in 2013 because the alleged trigger problems.

The Taurus class action lawsuit charged the Brazilian gun maker with suppression, failure to warn, violating the Magnuson-Moss Warranty Act, and state consumer protection laws.

“At all relevant times to this action, the Taurus defendants fraudulently concealed and intentionally failed to warn plaintiff and class members of the safety defects with the intent to deceive the plaintiff, class members and general public without knowledge of the defects,” the defective firearm class action lawsuit said.

    I have given up on Taurus. I sent back my PT111 In August. After repeated calls they cannot or will not give me an estimate of when they will repair and return it. They absolutely refuse to give me any information except to say they received it. That is the end of that. I asked that they send the gun back so I can sell it. I will buy a Ruger, S&W, Sig or Kahr. They are the absolute worst. Taurus is not a company you can trust and their guarantee means nothing

    I also have a pt-140 and did call the company and was offered to have them send me a PRE-paid evenlope and send it in to get look at. I am not sure what all this means and really I wish they would be more clear on this. Tauraus has a lifetime warranty anyway so they would do this with out the lawsuit. By the sounds of all this the wording is all jared up and they are trying to cover there ass. $200 will not purchase my gun so why would i let taurus have it for that. Now if they are giving us $200 plus fixing the gun i would almost go along with that. Not sure what t think about all this.

    I have a 24/7 pro-ls .40cal in ss that I purchased new in or about 2005, should I do anything despite not suspecting of having any issues I’m aware of? Should I suddenly not trust the thing anymore? Never had any cause not to… but if I should, then by all means what’s my next action?

      I called customer service and they emailed me a prepaid shipping label. Went to Fed Ex and put the gun inside a express shipping padded envelope then put that inside an express shipping box. Handed the clerk the prepaid envelope and was on my way. Two days later I received a conformation from Taurus hat they received the gun and would return in about 6 weeks.

    Ive been carrying my PT .145 Mill on my hip for about 5 years now all the while not knowing this! I paid $360 for the gun and supposedly the best I can get is $200?? What the heck am I suppose to do now? From the looks of it, I couldnt give this thing away!!

    My son just bought one of these brand new at a gun show 4 days ago, then he finds out about this defect. What can he do besdies turn the gun in for $130 or better loss?

      If bought new, he probably purchased a GEN 2 model and that is not part of this settlement.

    I have a Taurus Millennium. I knew about the problem with failing to eject a round properly, as I have seen the problem personally when my son was clearing the weapon to clean it and it discharged… through his finger. I need to know what to do about this new problem. Can we change the gun, get refunded etc???

      My experience was the same as Mark Colliers that is the only bullet fired from the gun,I just read about it today on face book, bought from Academy paid close to 400.00 its a mill145pro. do you have the customer service 1-800 number?
