Taurus

A class action settlement was reached between gun maker Forjas Taurus SA and Class Members, who claim that their handguns were made with defective safeties that are capable of firing when dropped, even if the safety is locked. If you own a Taurus handgun, you may qualify to benefit from this class action settlement.

Plaintiff Chris Carter filed the defective handgun class action lawsuit against Taurus, alleging that the Taurus pistols at issue “contain a drop-fire defect that may cause the pistols to fire when dropped from a normal height, and a false safety defect which allows the pistols to unintentionally fire even when the manual safety lever in in the ‘on’ or ‘safe’ position and the trigger moves rearward.”

Carter is a deputy for the Scott County, Iowa, sheriff’s department. He filed the class action lawsuit after his own Taurus gun fired while he was working one day as a narcotics agent and he dropped his gun on the ground in the middle of a pursuit. When the gun fell, it fired even though the safety was on. However, no one was shot, only a vehicle was hit.

Under the terms of the deal, Taurus will give Class Members extended warranties, training and $30 million to settle the allegations made in the class action lawsuit.

Taurus has also agreed to pay Class Members up to $200 for pistols that are returned to the gun maker. The $200 is based on fewer than 10,000 guns being returned. The minimum that class members will receive is $150, if 200,000 claims are filed.

Taurus denies any wrongdoing, but it has agreed to the terms of this class action settlement to avoid the cost and risk of going to trial. The Taurus defective safety class action settlement was granted preliminary approval on July 30 by U.S. District Judge Patricia A. Seitz.

Who’s Eligible

This settlement is for owners of the following Taurus-branded firearms:

  • PT-111 Millennium
  • PT-132 Millennium
  • PT-138 Millennium
  • PT-140 Millennium
  • PT-145 Millennium
  • PT-745 Millennium
  • PT-609
  • PT-640
  • PT-24/7

Note that the settlement does not include Taurus G2 model pistols.

Potential Award

This class action settlement provides safety training, a cash payment for Class Members who file a timely claim and return their handgun, and enhanced lifetime warranty benefits.

Here is a breakdown of the benefits:

  1. Safety Training: The training will address the operation and handling of the pistols affected by the class action settlement. Click here for more information.
  2. Payment Option: If Class Members opt to return their pistols to Taurus, they will receive a payment of up to $200, if 10,000 pistols are returned. The amount Class Members will receive will drop, if more than 10,000 pistols are returned. The minimum Class Members will receive is $31. Taurus will also cover the shipping costs to return the handguns.
  3. Enhanced Warranty: Class Members will be able to submit a warranty claim at any time, under the terms of the deal. If a warranty claim is submitted, Taurus will inspect, repair, and/or replace the pistol, if necessary, at no cost to the Class Members. Taurus will also cover all shipping costs. Proof of Purchase

Gun serial number is required to submit an online claim.  A safety video must be viewed prior to packing and shipping the gun to Taurus.  Once the video is viewed, a code will be provided, which also must be entered in order to submit an online claim.

    So, I met all requirements, mailed my pistol in quite a few months ago, have emailed the address on the class action site, but still no refund.
    Has anyone received a refund?
    This should not take so long, can someone explain what the heck the hold up is?

    Taurus did me wrong on this settlement. I sent back a stainless 2 tone and they r sending me a all steel black one back. Hopefully they feel the $40 difference they ripped me for is worth all the business I can stop them from getting.They definitely did not replace it make good for the value I paid for mine.Hopefully everyone reads this and takes a second thought before buying a Taurus Product.

    Does the money come from Taurus directly or does it come from the attorneys of the case. Whom do we contact if not received.

    If you have the Taurus 24/7 series, they come with a lifetime warranty, so the class action does nothing for you, but think about this…

    You paid Taurus $300 to $400 for the pistol, Taurus will give you $200 for the pistol, when they receive the pistol they do what they have to do to make it a safe firing pistol, no more than 45 minutes, and when they have a stack of maybe 200-300 they sell it as a lot for $300 to $325 a pistol, so they make a bunch more on the pistols, and that third party buyer sells them for $350 to $425 each… and your still stuck with your $200!
    You can go to Taurus’ site and find out if your pistol has a lifetime warranty, and if it does, you can send it in for FREE repairs, and you don’t have to go through an FFL.

    My Taurus is not firing properly, I would like to send it back for the $200 (I would still lose money) but I would not stand for the $31.00 if the max number of returns was reached. How can I find out how much they would pay me ?
