  • Why: Erin and Justin Barlup claim Ford manufactured and sold certain vehicles equipped with defective automatic transmission systems. 
  • Where: The class action lawsuit was filed in Pennsylvania federal court.

Ford Motor Company manufactured and sold certain vehicles containing defective automatic transmission systems, a new class action lawsuit alleges. 

Plaintiffs Erin Barlup and Justin Barlup claim Ford vehicles equipped with a 10R80 10-speed transmission since 2017 can shift harshly and erratically and cause the vehicle to jerk, lunge, clunk, hesitate, surge or slip between gears. 

The plaintiffs argue the allegedly defective 10-speed transmissions are equipped in Ford Expeditions, Mustangs, Rangers and F-150s and Lincoln Navigators with model years from 2017 to the present. 

“Drivers need a properly functioning automatic transmission in order to safely and reliably accelerate and decelerate their Vehicles,” the Ford class action states. 

The plaintiffs want to represent a nationwide class and Pennsylvania subclass of all persons who formerly or currently own or leased one or more vehicles equipped with a 10R80 10-speed automatic transmission. 

Ford refuses to replace or repair allegedly defective automatic transmissions, says class action

The plaintiffs argue the allegedly defective automatic transmissions equipped in the Ford vehicles present a “potentially life-threatening safety issue,” that the automaker allegedly refuses to address. 

“Upon information and belief, based on interactions between Plaintiffs and Ford authorized dealers, Ford refuses to replace or repair the Transmissions and merely states that the abrupt and harsh shifting is ‘normal,’” the Ford class action states. 

The plaintiffs claim Ford is guilty of unjust enrichment, negligence, breach of implied warranty and breach of express warranty, and of violating the Magnuson-Moss Warranty Act

The plaintiffs are demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual, statutory and punitive damages for themselves and all class members. 

The class action lawsuit expands on a previous complaint filed against Ford involving its 10R80 10-speed automatic transmissions that has been limited by a New York federal judge to Ford F-150 pickup trucks.

    2020 Ford Explorer XLT – Transmission through an error code at 71,100 miles and we were unknowingly outside of our warranty that ended at 70,000. It needs a complete replacement. There is metal shards all throughout the transmission. It sounded like it shifted out of Drive at 45mph to Park and it clicked for about 10 seconds straight then drove home fine. Took it to the dealership that night. It’s still at the dealership right now as I’m fighting to get them to replace it. Ford offered partial financial assistance, but not even half.

    I’ve got 2018 Expedition with 145.000 miles I took my vehicle to the dealership and they told I need a new transmission.

    I bought my wife a 2021 Lincoln Navigator Black Label, paid a pretty penny for the vehicle. Now just four years later with only 100,000 miles on it we need to purchase a new transmission. Can you participate in the class action lawsuit? We live in Michigan.

    We have a 2019 expedition max transmission is shifting really had but not throwing any codes. We had the transmission serviced thinking that would fix the problem but nope! It’s starting to get worse. Cluch feels like its slipping. What a train wreck! Ford take care of your business bro! Stop messing around with peoples money and lives

    i have a 2020 ford f150 and bought used at 75000 miles with a 10R80 transmission,5.0 engine and have the truck for one year and four months and now has 112,000 miles,, now i have it in a ford dealer shop for transmission slipping and stuck in low gears between 4th and 9 th gears. now they say that the warranty expired at 60,000 miles im second owner, dealer gave me two quotes for rebuilt and new transmission,cant afford the new one so i have no choice for the rebuilt,now they have all the parts except the hub assembly part# JL3Z7H351B:FRD (CDF DRUM) our main problem of the transmission issues, also they said its on back order. its not fair for me. i paid in full on this truck that i love and cant give up on it, would like help on the labor or some type of warranty. thank you..

    I have a 2019 Ford expedition max. has the 3rd to 4th gear hesistation and clunk shift. cdf drum is what im hearing. Shop said 8k to replace and rebuild.

    This is the third time my transmission is being repaired/this time it is being replaced. Each time the repair/replacement was done at a Ford dealership. This time the mechanics are independent and know what the heck is going on with Ford. The first time it was under warranty and they rebuilt the torque converter. The second time was a replacement with the same defective transmission (aluminum torque converter). This time I have a brand new, upgraded, fix for this problem to the tune of $10,000. This was after multiple Ford dealerships tried to push for installation of unnecessary engine parts.
