Ford side curtain airbags class action lawsuit overview: 

  • Who: John Solak filed a class action lawsuit against Ford Motor Company.
  • Why: Solak claims Ford sold model year 2022 Ford Maverick and certain other vehicles equipped with defective Safety Canopy side curtain airbags. 
  • Where: The class action lawsuit was filed in Michigan federal court. 

Ford Motor Company sold model year 2022 Ford Maverick and certain other Ford vehicles containing defective Safety Canopy side curtain airbags that can increase the risk of injury in the event of a crash, a new class action lawsuit alleges. 

Plaintiff John Solak claims Ford admitted last September that it sold certain vehicles equipped with defective Safety Canopy side curtain airbags and that it would not be providing a remedy for the issue until sometime this year. 

Solak argues Ford, instead of fixing the issue, simply advised vehicle owners to “wear their seatbelts” and to “drive with a little extra caution” until the automaker determined how to remedy the defect. 

“The Airbag Defect is a severe safety defect that increases the risk of serious injury in a side impact crash or rollover, including the risk that passengers in the front will be ejected from the Class Vehicle,” states the Ford class action. 

Solak wants to represent a nationwide class and New York subclass of consumers who have purchased, leased, or own a 2022 Ford Maverick or other Ford vehicle equipped with defective Safety Canopy side curtain airbags. 

Ford recalled around 65,000 model year 2022 Ford Maverick vehicles last August over defect

Ford initiated a recall for around 65,000 of its 2022 Ford Maverick vehicles in August 2022 over concerns they were equipped with defective side curtain airbags, according to the Ford class action. 

Solak argues that while Ford has allegedly said it will “eventually replace the side curtain airbags” with an anticipated availability being sometime this month, that it is “unclear whether this will come to fruition.” 

“In the meantime, because Ford has not provided consumers with replacement rental cars, consumers are forced to either … drive a dangerous vehicle … or cease using their Class Vehicle entirely,” states the Ford class action. 

Solak claims Ford is guilty of breach of express warranty, breach of implied warranty, and unjust enrichment, and in violation of New York General Business Law

Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of punitive, treble, exemplary, statutory, and compensatory damages for himself and all class members. 

A separate class action lawsuit was filed against Ford earlier this month by a consumer arguing the automaker has failed to permanently fix a defect in some of its vehicles that causes them to roll away unexpectedly.

    Just got a 2nd recall letter for this…now they say they will call me when they a fix for me!

    I purchased a 2022 Ford maverick. This is the 3 recall I have had. This is the second time for the side airbag. They have yet to replace anything.
