An asbestos mestheolioma lawsuit was recently filed by a grieving widow and daughter, alleging their loved one’s death directly resulted from asbestos exposure in shipbuilding. This man had various construction jobs throughout his life, in which he allegedly experienced asbestos exposure.
This asbestos mesothelioma lawsuit is being filed by plaintiffs Sandra M. and Lynn M., wife and daughter of the late Tyrone M. respectively, claiming construction company Avondale and other businesses knew the dangers of asbestos exposure in shipbuilding.
According to the wrongful death claim, Tyrone had worked for Avondale, Northrop Grumman Shipbuilding Inc., and other companies between 1965 to 2003 in various positions.
During the years 1965 to 1979, Tyrone reportedly experienced asbestos exposure in shipbuilding. In his work, asbestos fibers attached to his clothing and were directly inhaled, the plaintiffs claimed.
Overview of Asbestos Mesothelioma Lawsuit
Asbestos was a popularly used material for insulation purposes for its fire and chemical resistant qualities, and was a regular choice for companies for its low cost.
This fibrous material reached its height in popularity during World War II, utilized in numerous ships for the United States Navy. However, by the 1980s, awareness had grown that inhaling asbestos could potentially cause long term health consequences including rare but deadly mesothelioma, a form of lung cancer.
This use has resulted in numerous veterans and retired manufacturing laborers being diagnosed with asbestos-related lung disease. Many companies have faced legal action for failing to warn their employees or provide protective equipment against asbestos exposure. Before asbestos regulations were put in place throughout the 1970s and 1980s, Tyrone allegedly experienced asbestos exposure in shipbuilding on a daily basis and later developed serious health problems.
According to the asbestos mesothelioma lawsuit, the disease did not manifest until May 30, 2017 and was too advanced to treat. Tyrone ultimately died from mesothelioma almost a month later on June 29, 2017, with his wife and daughter later discovering the asbestos exposure in shipbuilding contributed to it.
It is important to note that mesothelioma is a very rare form of lung cancer that is specifically caused by asbestos exposure. This cancer is caused by asbestos fibers becoming trapped or embedded in the mucus lining of the lungs after being inhaled from the environment.
The fibers eventually fester into cancer cells, which slowly take over the lungs. Mesothelioma can take decades to show any symptoms, often resulting in latent diagnosis and limited treatment options. This means many mesothelioma patients have shortened life expectancies, even with the help of aggressive treatments.
Due to how devastating the health problems from asbestos can be, companies must disclose the possibility of exposure to employees if their products or materials contain asbestos. Sandra and Lynn allege the companies failed to do this, and did not warn Tyrone of his daily asbestos exposure from shipbuilding at any point.
Sandra and Lynn opted to file legal action against Avondale, Northrop, and the other companies listed in their claim together, alleging the companies either knew or should have known the dangers of asbestos exposure.
At all times relevant, Tyrone was working in an asbestos-laden environment or working around materials containing asbestos but was not aware of the potential health consequences.
Sandra and Lynn are raising multiple counts of negligence and failure to warn. Their Asbestos Mesothelioma Lawsuit is Case No. 2:17-cv-12367-EEF-JVM, in the U.S. District Court for the Eastern District of Louisiana.
