A new class action lawsuit alleges Eight Sleep misleads consumers into believing they are receiving a discount on its bedding products by displaying false reference prices on its website.
Plaintiffs Tushar Chopra and Brian Delshad filed the lawsuit against Eight Sleep on March 25 in California federal court, alleging violations of state consumer laws.
They claim Eight Sleep markets itself as a luxury brand that sells luxury mattresses and mattress covers designed to regulate a person’s temperature while sleeping.
“However, unlike a true luxury brand, Eight Sleep lists all of its products as having continuous discounts ranging between $50 and $200 off,” the Eight Sleep class action lawsuit states.
The plaintiffs argue that the discounts are false and designed to induce customers into purchasing Eight Sleep products.
Eight Sleep allegedly lists false discounts on its website
The lawsuit alleges that Eight Sleep’s website lists various items on sale or at a discount, showing a stricken former or prevailing market price next to the “sale” price.
However, the former price is not actually the price at which the product was sold in the previous three months, the plaintiffs say.
The Eight Sleep class action lawsuit further alleges that the false discount scheme has deceived hundreds of thousands of customers across the United States, resulting in the company profiting millions of dollars by selling products at misrepresented discounts.
The plaintiffs want to represent a California class of consumers who purchased at least one item from Eight Sleep at a represented discount from inflated reference prices.
Another bedding company, Sleep Number, is also facing a similar class action over allegations it used fake reference prices for discounted mattresses sold online and in its stores.
