Unum Life Insurance Company of America is facing legal action over allegedly denying a Florida woman disability insurance coverage.
Even though this woman was previously employed for a number of years and had rightfully earned disability insurance coverage, the insurance giant denied her claim allegedly under illegal circumstances, according to her lawsuit.
Plaintiff Syreeta H. had been fully employed with Marriott International for a number of years, and was provided with long-term disability insurance coverage should she become injured or ill. However, she became unable to work due to her disabilities and eventually had to resign in March 2007.
These disabilities reportedly prevented her from being able to perform her occupational duties, which caused Syreeta to stop working and file for long-term disability benefits. During all times relevant, Syreeta had qualified for long-term disability insurance coverage under Unum’s requirements and had followed all administrative procedures when filing.
Syreeta had filed for disability insurance coverage in a timely manner, and had also filed any relevant medical testimony that proved the severity of her condition. This testimony would have told Unum that she was unable to work or would have been unable to work in any similar occupation, and would not have been able to earn sufficient income.
Overview of Unum Claim Denial Allegations
Even though Syreeta proved that not only was she eligible for long-term disability insurance coverage and that she also needed the coverage, Unum still denied her claim, she states. Even though Syreeta appealed the decision, filing all necessary paperwork and medical testimony for a second time, Unum had still denied her claim for long-term disability insurance coverage.
At this point in time, Syreeta has exhausted all administrative options and has been forced to file legal action against Unum. Syreeta is not only filing this Unum lawsuit for denying her claim under alleged unlawful circumstances, but for also failing to perform a “full and fair review” of her disability insurance coverage claim.
Unum Life Insurance Company of America is one of the largest disability insurance providers in the United States, with millions of policyholders relying on the company if the time ever comes for them to need disability coverage. However, Unum has been accused of using various claim denial tactics to dismiss legitimate claims to maintain as much as money as possible.
Unum has been accused of ignoring relevant medical testimony in favor of their own third party opinions, and completely dismissing claims based on false evidence. Syreeta claims that the decision to deny her long-term disability insurance coverage was not based on relevant evidence and did not come to a fair conclusion.
Syreeta is seeking damages for all missed payments, along with any interest or other relevant damages.
This Unum Disability Insurance Coverage Lawsuit is Case No. 6:17-cv-00472-MGL, in the U.S. District Court for the District of South Carolina, Greenville Division.
