Diamond of California Walnuts Class Action Settlement

UPDATE: The deadline to file a claim for the Diamond Walnut settlement has been extended to October 26, 2012!
 
Did you purchase Diamond of California brand walnuts between 2006 and 2012? You may be able to receive a refund of $3.25 or $8.25 per bag you purchased from a class action lawsuit settlement with the company.

The Diamond walnut settlement will resolve a class action lawsuit, entitled Elliot Zeisel v. Diamond Foods, Inc., that alleges Diamond Foods misbranded its walnut products by making false and misleading statements about the health benefits of eating walnuts.

Diamond denies any wronging, but has agreed to provide $2.6 million in restitution to consumers to end the litigation.

Under the Diamond walnut class action settlement, consumers who purchased Diamond of California brand walnuts (including, but not limited to, Shelled, Halves, Chopped, Finely Diced, Chips, Nut Toppings, and In-the-Shell Walnuts) in the United States from March 22, 2006 through January 30, 2012 are entitled to receive a share of the class action lawsuit settlement.

Class Members who purchased a 3-pound bag of Diamond of California walnuts at Sam’s Club are entitled to receive $8.25 per bag purchased during the Class Period, while Class Members who purchased any other Diamond of California walnut product can receive $3.25 per bag.

To receive your cash refund from the Diamond walnut class action lawsuit settlement, you must submit a claim form either online at www.WalnutLabelingSettlement.com or via first-class mail no later than September 7 October 26, 2012. You do not need to submit Proof of Purchase unless you are claiming more than three 3-pound bags of walnuts or more than five bags of any other walnut products. Even with appropriate Proofs of Purchase, the maximum number of bags you can claim is 24.

    So the walnuts didn’t cure your heart disease? Duh! Did you really buy walnuts for the health benefits or because they just taste good and go great in baked goods. Give me a break! I think just about every label in the stores could be misleading!

    I have multiple Sams Club identified receipts with my name, membership number, date of purchase etc, with the purchase identified on the receipt as “309097 walnuts (followed by) price.” However, the administrator informed me that the receipt must specifically identify the walnut purchase as “Diamond Walnuts”.

    So much for filing a claim in excess of three bags!!!!!

    I make large purchases during the holidays for baking,and making party mix ,candy and fudge to give out to the garbage collectors, postman, neighbors, family and friends. Having no proof of purchase.. I can only claim 5. I have no way of knowing the actual count ..but can easily claim approximately 60 purchases in this time period allowed.

    i bake alot of red velvet cakes and use these nuts……i have purchadsed more than the amount listed to receive refund without proof……my problem is who would have a receipt for nuts since 2006……..

    What a crap lawsuit! Walnuts as well as other nuts are good for your health. This is probably action arising out of big Pharma’s and their lackey the FDA’s assault on natural foods and the health benefits of eating just about anything but processed foods which are full of chemicals, additives and other crap (like the secretions from the anus of the beaver) that are responsible for our ever increasing number of obese children and adults as well as a plethora of health problems for which big pharma wants to inoculate you against.
