Cox CommunicationsA proposed Cox class action lawsuit that accuses the cable company of intentionally hiding fees by mislabeling them in a confusing way in order to charge more for certain television services has been moved to a California federal court.

Plaintiffs Matti Yousif, Elizabeth Ioane, Zach Beimes, Dawn Harrell brought the hidden cable fees class action lawsuit against CoxCom LLC and Cox Communications California LLC after noticing that there were added “Advanced TV” fees in addition to recurring fees and applicable discounts.

The plaintiffs allege that despite marketing materials that advertised that the price of Advanced TV was all-inclusive (except for government-mandated applicable taxes, fees, and surcharges), Cox added unauthorized charges for the television cable service without the knowledge or consent of its customers.

The Cox hidden fee class action lawsuit claims the company committed these acts “with the intent to induce members of the public to purchase its products.” The plaintiffs claim that thousands of Cox customers relied on their false advertising campaign and lost money because of it.

The plaintiffs live in three different states and if the Cox class action lawsuit is approved, Cox customers in Arizona, California and Nevada who paid additional fees under “Advanced TV” within the last four years may qualify to join as Class Members. There are more than 400,000 Cox subscribers living in those states that subscribed to Advanced TV, according to the Cox hidden fees class action lawsuit.

However, the wording of the Cox class action lawsuit is unclear just how much money the class action would seek. The plaintiffs allege they lost $50 in hidden fees, but it is uncertain whether that is a collective amount between the four plaintiffs or an individual amount. If it was a collective amount, Cox could be facing a $5 million class action lawsuit. If it was an individual amount, the cable company may be facing a $20 million complaint based on the 400,000 Advanced TV subscribers.

Due to the substantial financial implications along with the fact that at least one plaintiff lives in a different state than the defendant, the proposed class action lawsuit was recommended to be moved to the U.S. District Court for the Southern District of California.

Plaintiffs Yousif and Ioane, who are California residents, are suing Cox for unlawful business acts, false advertising and violations of the Consumers Legal Remedies Act. The Cox class action lawsuit states that the defendant violated the act by making representations and advertisements concerning the pricing of Advanced TV “when it knew, or should have known, that the representations and advertisements were false, deceptive and misleading.”

Plaintiff Beimes of Nevada is alleging Cox violated Nevada’s Deceptive Trade Practices Act and plaintiff Harrell of Arizona is alleging the cable company is in violation of Arizona’s Consumer Fraud Act.

The plaintiffs are represented by Derrick F. Coleman and R. Jeffrey Neer of Coleman Frost LLP.

The Cox Hidden Fee Class Action Lawsuit is Yousif, et al. v. Coxcom LLC, et al., Case No. 3:15-cv-01499, in the U.S. District Court for the Southern District of California.

    There should be a class action against cox for dropping the local channels in las vegas, which they sold us on always having, Cox is a monopoly and should not be able to hurt their customers for dropping local tv. We get no premium channels and pay over $150 per month.

    I sign up with cox in the beginner of December 2015, a month ago. As so many of their customers out there I have been promised the moon and the stars, based on their wonderful promotion they had at the time and end up with weeds. I asked the agent over and over to assure me about their Price Lock Guarantee. Every time is been state to me the same think: don’t worry it wont be a penny more. The installation process was horrible not because of the technician, because they messed up my order several times. Anyway …at one point was done properly with the bundle I requested, Gold Bundle. 6 days later I am able to see my statement: $130.00 overcharged. After several hours on the phone, a very nice manager notice the mistake. She adjust everything and assure me to stay worry free. 3 weeks later I am still overcharged, with $20.00 only – this time for the whole 24mo. This time another manager (I did not have patience for regular representatives anymore) told me that the original bundle I ordered and an entire country could see this offer online IT DID NOT EXSIST. According with him, my current bill is correct as it is and they never had the promotion I was talking about it. Well I told him I have the promotion printed on my desk. His argument now was that there were two Gold Bundle at the moment. Actually he tried to convince me that what they had silver bundle at the time , now for him was another type of Gold bundle. To make the ugly story short I end up in a big Bait and Switch trick. Since I knew their phone calls are recorded because they inform you at all times, I asked my right of getting those records, to prove them that what’s happening now is a big Scam. This request made the agent to place me on hold and shortly after according with the agent they their system experience difficulties and a manager has to call me back. I will love to file/ participate in this lawsuit against them. My lawyer will start a process against them soon, but I can give my participation to many other there. I cant even imagine how many other customers are ripped off out there.

    I cancelled all services with Cox Communication on Oct. 7, 2015 and return all equipment on Oct. 8, 2015, received final bill and paid it right away. Just received a phone bill from them and when I called to tell them that said phone is no longer in service and that I cancelled all services. I told that if you call that number it says out of service. They said other cable co. should have cancelled it. I said I did that when I call you and that this is trickery. They still want me to pay for services they are not providing?

    I have been a Cox customer for over ten years. When my monthly bill was getting too expensive with their constant bill increases I called Cox’s customer loyalty department to see if I could get some discounts for my monthly service or I would need to shop for another service provider. This was on 6/24/2015; they were able to cut my bill about $60 a month, so I agreed to stay with them. They told me that there would be no change in my services, just the discounted rate that was good until 06/23/2016. That was true for two months, however for my statement dated 09242015, they had charged me $18.90 for calls that were free under the phone plan that I had previously (and thought that I still had), so I called them, they told me they no longer had that plan and put me on a $24.99 a month plus .18 cent per minute plan without my knowledge and said that they would be happy to put me in the more expensive plan, $29.99 with .05 cent per minute charge per call. They then stated that every call out of my 858 area code is considered long distance even though some of these people are within 5 miles of me. I told them that was a breach of contract and that I would pursue other avenues.

    just found sports and info pak added to our bill back in nov 14 never asked for it they have been charging us 10.00 extra so when we called we just asked them to drop it. so today i go on cable now i have all these extra channels so they were charging us and not even giving us the channels im not done with this

    I have been getting a $5.00 fee every month. It states it is a TV tax(?). I have repeatedly told them that I dont even own a TV. I subscribe to internet only.

    They raised their rates on internet with the claim 100mbs , they couldn’t do it. I’m in Ks like to know if they are being investigated here. I know people pay a lot for Cox Services , Im just over $100 a month and have had nothing but problems from them with everything. Not getting my moneys worth , at all.
