cox class action lawsuitA judge in a class action lawsuit alleging cable company Coxcom LLC intentionally mislead consumers about hidden fees agreed to send the case to arbitration.

Lead plaintiffs Matti Yousif, Elizabeth Ioane, Zach Beimes, and Dawn Harrell initiated the class action after noticing additional fees called “Advanced TV” fees on their Cox cable bills. They alleged that Cox’s marketing materials advertised that the price of Advanced TV was all-inclusive (except for government-mandated applicable taxes, fees, and surcharges), and that Cox had added unauthorized charges for the television cable service without the knowledge or consent of its customers.

Cox filed a motion to compel arbitration, which would force the plaintiffs to move their dispute from the California federal court. Cox argued that upon agreeing to service, the plaintiffs had 30 days to opt out of the arbitration clause in their contracts. Since the plaintiffs had entered into the service agreements in 2011 and not opted out of the arbitration clause, U.S. District Court Judge Janis L. Sammartino granted Cox’s motion and ordered the parties to arbitration.

The judge pointed out in her order that the subscriber agreement indicates “YOU AND COX AGREE TO ARBITRATE – RATHER THAN LITIGATE IN COURT – any and all claims or disputes between us . . . that arise out of or in any way relate to: (1) this Agreement; (2) services that Cox provides to you in connection with this Agreement; (3) products that Cox makes available to you; (4) bills that Cox sends to you or amounts that Cox charges you for services or goods provided under this agreement and (5) any services or goods that Cox or any of its affiliated entities provide to you under any other agreement . . . . The arbitration between you and Cox will be binding and judgment on the award rendered in the arbitration may be entered in any court having jurisdiction thereof.”

The class action plaintiffs argued that the arbitration clause is found in a service contract related to internet service and should not be applied to their allegations related to Cox’s billing for Advance TV fees; however, the judge pointed out that the internet service contract also contains a clause that “unambiguously” requires arbitration for claims that relate to any services or goods that Cox or its affiliates provides under any agreement.

“There can be little doubt that this arbitration clause — even though nested in an agreement geared toward high-speed Internet — encompasses claims arising from Cox’s provision of cable TV services,” concluded the judge in her order compelling the class action lawsuit to be resolved in arbitration.

The judge concluded by granting Cox’s motion to compel arbitration and finding Cox’s other motion to dismiss moot. The judge stayed the class action lawsuit in federal judicial court pending the outcome of arbitration.

    I can only choose Cox in my area, so all price increases/Spotty services/Data Caps are part of my everyday life. I pay $180 for GIG service but it’s only in one direction…meaning I can’t take a Zoom call while my family watches a movie. I pay for Data caps and over the limit charges ($56.99-$83.99) every month and during the pandemic there were several increases. Cox holds these council meeting to ask for increases but it’s not publicized so none of the actual customers are represented. Isn’t this an Anti-trust issue?

    i was told total would be $89.99 per month… then it jumped to $130 “after taxes” then it jumped to $180!!! and I pay for 2 accounts for my disabled mother and disabled brother!!!!

    I paid $213 for years via automatic payment. Last month it jumped to $279. I called to complain and they adjusted me to a new promotion back down to $213. Promising apply the difference to next month bill. I was charged $313 this last month. This is robbery! Canceling service today!

    After the first year of my two year agreement, my bill went up $30. They said it’s in its plan, however you sign your plan over the phone without any information about the second year increase. Plus $30 extra for not even the premiere package?

    I am a former employee of Cox Communications who was discriminated against, and then they tried to charge me for services I cancelled. They also sold me a modem that was supposed to be a Docsis 3.1 but turns out it was a docsis 3.0 modem. I would like to file suit against them as well. If anyone is looking for a discrimination lawsuit against this company please let me know.

    I live in Arkansas – I’m a widow of a veteran who died from his service connected injuries- my money comes from death benefits – cox has been cheating me for years – have had enough! I’m willing to start a class action

    WE NEED TO SUE COX. Horrible customer service! They promise you all these channels for a price and i have a print out of the channels i was promised and yet after being able to watch HBO and stars for 2 months, all of a sudden it says i have to subscribe which is strange. So i call cox, explained the situation, of course they cannot help me and don’t believe me . The sales person who set this up for me in the beginning listed the channels for me and said a guarantee price including tax, AND NOW, instead of pay $107 like promised, I pay $148 the second month now $132 the second month and have to pay extra for HBO. so then Starz came off our channels now, and they’re trying to make me pay for it. that is why no one goes with cox and always talk crap about cox. i definitely see why now.
