Court Approves $69M Volkswagen/Audi Leak Sunroof Settlement

VolkswagenAudiA federal court has approved a $69 million class action lawsuit settlement over leaky sunroof problems on 80 different Volkswagen and Audi models. Class Members that submitted a Claim Form by the deadline can expect to receive their settlement checks in the mail within the next 45 days or so.

The settlement brings an end to a “difficult and complex” class action lawsuit that lasted more than five years and suffered several major blows, including a settlement rejection earlier this year over fairness issues. A new Volkswagen/Audi leaky sunroof class action settlement was reached that provided equal benefits to all Class Members and allowed additional vehicle owners to participate.

On December 14, a New Jersey federal court approved the amended Volkswagen/Audi leaky sunroof class action lawsuit settlement, which will provide reimbursements and other benefits to Volkswagen and Audi owners that suffered damage caused by sunroof drainage problems.

Volkswagen also agreed under the final settlement to pay attorneys’ fees separately from the reimbursement fund and to grow the fund if necessary, thereby guaranteeing Class Members will receive 100% on their claims.

“I have to give credit to defendant Volkswagen to be willing to do that,” said Samuel P. Sporn of co-lead counsel Schoengold & Sporn. “After all, it’s their customers.”

The deadline to file a claim for the Volkswagen/Audi Water Ingress Class Action Lawsuit Settlement was November 26, 2012.

    This certainly needs to be reopened. Countless problems and lots of money spent fixing this issue.

    This settlement should be amended or reopened. We have never moved since owning our 2006 VW Touareg, still have it, and have paid for the repair more than once out of warranty and out of pocket, and a new headliner. VW has never contacted us at all about this.

      I have a Q7 with a sun roof leak also. Paid $2,200 for repair. Is Audi doing anything about the design flaw or us there a lawsuit? ?

    2010-Q7- I unknowingly paid for replacement of the sunroof drains $1.100. The tech mentioned at the time that I was lucky the amp didn’t go out. That was a red flag to me. Who designs a car to leak on electrical parts if a drain is clogged? I’ve had 2 Accords, 2 Jeeps, 1Cadillac CTS, and an Escalade ALL with sunroofs , NO LEAKS! If they know it’s a problem, why not inspect/clean as part of routine maintenance? Well my amp went out two weeks after the replacement now they want another $1,700, but dealer has agreed to pay $800. I am not paying a dime based on my research and this lawsuit. I will be contacting an attorney if I don’t get satisfaction. It’s a shame though cause my very first car at 16 was an old Audi traded that because of issues and decided to give them another chance. Humans are only animals to trip over same rock twice! Anyone else have suggestions.

      Hello, is there any info you received with the check about who to contact? We never got a check & should have, but I am afraid because I have moved that maybe it cost lost in the mail. The website & email nor the phone number on the original info do not work anymore. Any info you have would be greatly appreciated.Thanks

    I purchased used 2008 Audi q7 from an Audi dealer. After owning this vehicle for 8 months and 4000 miles my MMI stopped working. Brought it back to the dealer and it was confirmed that water leaked in and caused damage to my bose amplifier and navigation system. My insurance company got involved due to the excessive damages which in total of $8900.00 to replace those components and entire sunroof frame with and other boards and sunroof motor. This truck first went for this issue in February 2014. After 30 days in the shop finally got back my truck. In September 2014 took my truck thru a spray only car wash and noticed gallons of water rushing in on passenger side. Brought the truck back to original dealer and after 2 day’s of diagnosing the problem it is again the sunroof frame leaking water, I was told the sunroof frame was not sitting on the truck frame properly so they will have to replace it again. Can anyone help point me in the right direction since I believe this will be an issue and I feel this q7 has been trashed no value. Tonka truck with a nice ride.
    PS- I originally argued with audi dealer that they failed to inform me of the issue with clogging of roof drains, I brought the truck in for its schedule miles maintenance 2 months before the original damage. Didn’t know about any of this craziness until after the fact.

      What insurance company do you have? My insurance company rejected my claim. I am having water leaking again through the sunroof and it’s causing electrical issues again. It was just repaired a couple years ago. It’s garage kept and hardly ever sees the bad weather.

    I was told that disbursements would begin in February 2014. I was also told that updates would be posted.
    So far neither has happened

    We just purchased a used Q7 and it has the leaky sunroof and the Audi dealer just informed us after looking it over that its the track which is what I believe was most of the problems with leaks. We are hoping Audi here in Appleton WI to do the right thing and take care of it for us.

      Audi took care of the sunroof track but it still leaks and now has electrical issues causing battery drain. It is back at the dealer for a second time after being replaced. The parent dealer paid for the new sunroof track, seals and drain tubes plus labor. Now, the parent dealer does not want to pay for the electronic parts that may be damaged from the water and the Audi dealer may not either. My next step is to obtain legal counsel and see if I can get this taken care of. Since the lawsuit date has passed, my vehicle would normally not be covered but after some arguing they decided to repair it the first time. Audi/VW should own up to this no matter how old the lawsuit is and do the right thing. Our Q7 is an 07 and was part of the orginal court action.
