chronic kidney disease from NexiumAstraZeneca and its related companies face a couple’s Nexium lawsuit due to adverse long term side effects suffered from treatment with the proton pump inhibiting drug known as Nexium (esomeprazole magnesium).

The couple filing the Nexium lawsuit are plaintiffs James T. and Norma T., residents and citizens of the state of North Carolina.

According to the Nexium lawsuit, James was prescribed and began taking Nexium as early as 2005. He continued his use of the medication through 2014.

James alleges that he never would have agreed to be prescribed Nexium had he known of the kidney risks associated with the medication.

He states that due to taking Nexium, he suffers from chronic kidney disease, end stage renal disease, is named on a kidney transplant list, and is on dialysis.

James claims he sustained pain, suffering, severe and permanent personal injuries, and that his spouse Norma suffered from a loss of consortium due to her husband’s injuries and adverse side effects suffered.

James and Norma allege that only recently did they “become aware that their injuries could have been caused by the use of Nexium.”

Nexium Overview

Nexium (esomeprazole)
is a proton pump inhibitor prescribed to treat symptoms of gastroesophageal reflux disease (GERD) and other conditions such as Zollinger-Ellison syndrome. The drug is prescribed to decrease the amount of acid the stomach produces. It is also prescribed to help heal damage caused to the esophagus, due to stomach acid, known as esophagitis.

Some other conditions treated by Nexium include stomach, gastric or peptic ulcers, stomach infections, heartburn, and acid indigestion.

Nexium Lawsuit Allegations

Nexium lawsuits, filed against the drug’s manufacturer, allege that the company failed to warn about the risk of kidney failure to both doctors and patients.

Patients allege that if they were aware of the drug’s side effects and risks, they would have never agreed to the medication and would have chosen an alternative drug. They also allege that if their physicians knew of the drug’s risks in causing such adverse effects, they would have also monitored their patients more closely.

The risk of life-threatening side effects has been linked to short-term and long-term use of Nexium. Some of these side effects include AIN, or acute interstitial nephritis, and severe reactions to Nexium can result in acute kidney (renal) failure, which may lead to death.

Patients taking Nexium have also complained of common Nexium side effects including diarrhea, nausea, vomiting, stomach pain, dry mouth, rash, dizziness, and nervousness.

Throughout the United States, more than 15 million Americans are prescribed Nexium and other proton pump inhibitors like Prilosec. In sales between Apr. 2014 and Mar. 2015, Nexium was ranked fourth in prescription drugs sold in the United States. During this time frame, Nexium alone sold nearly 15,298,228 prescriptions.

The Nexium Lawsuit is Case No. 2:17-cv-12562-CCC-MF, in the U.S. District Court for the District of New Jersey, Newark Division. The Nexium MDL is In re: Proton Pump Inhibitor Products Liability Litigation (No.II), MDL No. 2789, in the U.S. District Court for the District of New Jersey, Newark Division.

In general, acid reflux medication lawsuits are filed individually by each plaintiff and are not class actions.
