Honda class action lawsuitAmerican Honda Motor Co. has agreed to a class action lawsuit settlement over claims it manufactured defective Accord vehicles that burn oil too quickly. As part of the settlement agreement, Honda has agreed to provide “valuable benefits” to Class Members to resolve the litigation.

The Honda Accord class action lawsuit was originally filed in March 2012 by plaintiffs Vince Eagen and Alex Soto. They claimed that 2008-2010 Honda Accords contained a “systematic design defect that enables oil to enter into the engine’s combustion chamber,” causing the engine to excessively consume oil. This alleged defect led to engine malfunction and premature spark plug degradation. The plaintiffs claimed that Honda refused to honor warranties covering the defective Accords.

According to the class action lawsuit, Honda had received hundreds of online complaints about the Honda Accord oil defects and issued a technical service bulletin notifying Honda technicians to check for symptoms of the defect. Despite this knowledge, Honda refused to take action to fix the problem, the plaintiffs said.

Further, the plaintiffs alleged that even though the defective engines needed to be repaired within the warranty period, Honda refused to fix the parts for free. Instead, Honda told its customers to check their vehicles’ oil levels every time they get gas. Eagen claims that he had to add a quart of oil to his Accord each month, and had to replace his prematurely corroded spark plugs twice within 55,000 miles of driving.

Under the terms of the Honda Accord class action settlement, Honda agreed to extend the Powertrain Limited Warranty of each settlement class vehicle for engine misfiring for up to eight years after the original sale or lease of the vehicle, without imposing a mileage restriction. Honda also agreed not to contest the class counsel attorneys’ fees if they do not exceed $800,000 and will allow Class Members to submit a claim for reimbursement for their out-of-pocket expenses.

The class action lawsuit was also amended to limit Class Members to include only owners and lessees whose vehicles may have experienced engine misfire, to include only allegations related to engine misfire, and to voluntarily dismiss claims related to excessive oil consumption in 4-cylinder Accord vehicles.

This class action settlement was reached after a California judge declined to force arbitration on the case in October 2012. U.S. District Judge Susan Illston found that Honda was a third-party non-signatory to a contract and therefore was not able to compel arbitration under the contract’s terms.

    Another loyal Honda customer lost here! I bought my 2008 4cyl. accord brand new in 2008 I am now at 62,000 miles and my car in consuming immeasurable amounts of oil. I have been to Shottenkirk Honda of Cartersville (don’t go there) 4 times in 3 weeks dealing with this issue and they will not admit there is a oil consumption problem. Obviously, I am under the warrantied millage and year limit. I have reached out to American Honda and also, nothing is being resolved. I will not be like the hundreds of others with blown up engines and failed timing belts paid out of pocket. My family and I will NEVER buy another Honda.

    I just went through this same runaround. Apparently the class action lawsuit only applies to 6 cyl, and not 4cyl like mine. The 6 cyl vehicles are getting repairs regardless of mileage. This was my second heated discussion with Honda customer service where they essentially told me I was out of luck as my car is now well past the 125000 warranty extension. We need a class action lawsuit for the 4cyl owners as well. Unfortunately my case is not well enough documented for this. Anyone with a 6 that is in the affected range should be able to get their problem repaired, as a result of the lawsuit. The rest of us are screwed.

    We bought a 2009 Honda Accord brand new in July 2009, at 90,000 miles I lost all of my oil at only 60% oil life used. I got a letter in mail last week telling me about this issue but it has a 125,000 mile limit for them to fix this, my car has 141,000 on it now they told me it would cost me 2700.00 to fix this Please help me cover this cost…. my car has since started misfiring on start up as well….

    Own 2009 4 cyl lx . Car burns oil and rattles on cold start up. Now mechanic says engine and timing belt need replacement as a result. Please help

    I have a 2010 Honda Accord with 64,000 miles. I just started noticing the oil light blinking on periodically. I also notice my muffler sounds like its clogged. Maybe it is due to the oil burning problem.

    Honda EX-L 6 Cylinder burns a 1/2 quart every 200-300 miles. Please include me in this class action suit.

    I bought a new 2008 Honda accord EX 4 cylinder and from day 1 found it used oil. At first I would have to replace a quart every other monh or so – that in creased to every 1000 miles. I took it to Honda and they said – That engine uses a quart per 1000 miles. I took it back to Honda 6-7-8 times for the same issue – they finally admitted there was an issue, did an oil consumption test, did something with the computer system and then said that was all. About a year ago the car made an odd sound when starting cold. They said just keep the oil full. A month ago the timing chain went and $1400 later – hence the noise when starting cold!! Honda then they admitted that there was an issue and there was a recal on this model. They then proceded to tell us the recal was good to 125,000 miles. Of course ours has 150,000. Honda America denied our request to fix the issue through the recal even though we have been complaining about it since 2008. This was my 4th accord, we have an Odessey and have had Pilot. HONDA AMERICA, you have lost this customer. I wll never purc a Honda again – as will anyone in our family. They know our fustration. Honda – YOUR LOSS

    My 2007 honda accord is using up to 2 quarts of oil between oil change I ask honda dealer if i need to use thicker oil or what they recoment but thay act lije if it was not a big deal.

    have a 2007 accord bought new, started the consumption at 80000km !!! the engine just add miss fire last week cyl 4..(130000km) After investigation no more compression on the cylinder due to burnt valve … oil consumption result….. Now im fighting with honda…. !!!

      good luck with that. We are fighting over our 2008. Burns a quart every 750 or so miles. Just had to replace the Timing Chain due to the oil issue. Honda has a recal but will not include our car as it has 150k miles. we started com[plaining about the issue right after we purchases the car in 2008.

      We are done with Honda – Too bad cause we have really good luck with all of our other honda models

    I also own a 2009 Honda Accord 4-cylinder. Oil life read 40%, but there was not a drop of oil in the car. This has happened twice already. Last oil change was less than 2.5 months ago. Car is currently at the dealership. Please include me in these notifications.
