A new class action lawsuit accuses Walgreens of selling an unapproved testosterone booster that is both ineffective and unlawful.
Plaintiff Jason Ferguson filed the class action complaint Sept. 30 in California federal court, alleging violations of state and federal consumer laws.
According to the lawsuit, Walgreens sold its own brand of testosterone booster, Walgreens Men’s Testosterone Complex, with claims that it could increase testosterone levels, muscle mass, strength, endurance and sexual function.
Ferguson argues that these claims are false and misleading, as the product is neither safe nor effective for its intended purposes.
Lawsuit: Walgreens testosterone booster is an unapproved new drug
Ferguson alleges that Walgreens’ testosterone booster is an unapproved new drug that violates the Food, Drug and Cosmetic Act and California’s Sherman Food, Drug and Cosmetic Law.
He claims that the product contains no ingredients that can safely and effectively increase testosterone or improve sexual performance, and that Walgreens marketed it with deceptive efficacy claims that suggest it has medical benefits akin to prescription drugs and hormone therapies.
Ferguson purchased and used Testosterone Complex with the belief that the product was safe and effective and sold in compliance with state and federal regulations, the Walgreens class action lawsuit says.
The plaintiff claims he bought the product at least three times from Walgreens stores in California, most recently in December 2023, thinking it would help him with his testosterone levels, muscle mass and libido.
He says he assumed that products sold by a large company like Walgreens would comply with the U.S. Food and Drug Administration regulations and California law.
The lawsuit alleges that Walgreens’ conduct was fraudulent, unfair and unlawful, and that the company should be held accountable for selling an illegal and ineffective product.
Ferguson is looking to represent anyone in California who bought the Walgreens testosterone booster from January 2019 to the present. He is suing for violations of California’s Unfair Competition Law, False Advertising Law and Consumers Legal Remedies Act and is seeking damages, restitution and injunctive relief.
Meanwhile, a group of consumers recently filed a class action lawsuit against Strides Pharma, alleging the company sold testosterone gel containing benzene, a known carcinogen, without proper disclosure or compliance with safety regulations.
