UPDATE 10/7/13: Payments for the Citizens Bank Overdraft Class Action Settlement went out on September 19, 2013.

UPDATE 6/19/13: Distribution of Settlement Awards in the Citizens Bank Overdraft Class Action Settlement will be made in September 2013.

The claims filing deadline for the Citizens Bank overdraft fee settlement has been extended to May 6, 2013. If you paid overdraft fees to RBS Citizens, Charter One or Citizens Bank between 2002 and 2010, you may be eligible to receive a cash payment from the class action settlement.

The Citizens overdraft fee settlement will resolve allegations the bank manipulated the order that debit card transactions were posted in order to rack up overdraft fee charges. Plaintiffs claimed that RBS Citizens Bank, including its Citizens Bank and Charter One brands, improperly failed to decline transactions when an account had insufficient funds to cover a purchase, and instead processed transactions from highest to lowest dollar amount to maximize the number of overdraft fees assessed to customers.

Citizens Bank denies the allegations, but has agreed to a $137.5 million settlement to resolve its portion of the consolidated class action lawsuit In re: Checking Account Overdraft Litigation.

Class Members of the Citizens Bank overdraft settlement include anyone who:

  • Had a Citizens consumer deposit account that could be accessed with a Citizens debit card anytime between January 1, 2002, and August 13, 2010, and/or had a Charter One consumer deposit account that could be accessed with a Charter One debit card any time between July 25, 2005 and August 13, 2010; and/or
  • Had a consumer deposit account with an Acquired Bank ( see below) that could be accessed with a debit card between January 1, 2002 and August 27, 2007; and
  • Were charged one or more overdraft fees as a result of posting debit card transactions from highest to lowest dollar amount.

To be included in the Settlement Class, you must have had two or more overdraft fees caused by debits posted to your account on a single day during the time period listed above.

Class Members that held a Citizens or Charter One account during the class period will automatically receive a payment from the class action lawsuit settlement. Class Members that held an account from an Acquired Bank will need to file a Claim Form by the deadline of May 6, 2013.

Acquired Banks include:

  • Mellon Bank’s former Mid-Atlantic Franchise Branches (PA, DE, NJ)
  • Medford Savings Bank (MA)
  • Commonwealth Bank (PA)
  • CambridgePort Bank (MA)
  • Community National Bank (MA)
  • Roxborough-Manayunk Bank (PA, DE)
  • Charter One Bank, N.A.
  • GreatBank (IL), GreatBank Chicago, and First National Bank (IL)

The amount of money you can receive from the class action settlement will depend on how many improper overdraft fees you incurred.

  2. michelle says:

Funny how i changed banks a few years ago and have not been charged one fee. I wish i had the time and energy to add up the thousands in fees that citizens has charged me. Would be nice if I even got 1/2 back. I would probably be able to take a nice trip. Hope they learned their lesson. Bring on the money!! You had no problem taking it now what is the hold up getting it back??????

  3. Leonessa says:

According to the settlement website, payouts will not occur until September 2013

  4. money says:

Does anyone have any info on When we will receive this money ???

  5. Steve F. says:

I seriously thought we’d have been paid back by now. I don’t understand what the delay is. Pay me back Citizens!!

  6. Paul says:

Citizens may have settled for pennies on the dollar but they are still stealing people’s monie with the same overdraft policies. I have to wonder where is the government and the banking commission to protect consumers. Just another case of the rich screwing the poor.

  7. VSP says:

I find it funny that they are denying any wrongdoing, but agreed to pay out $137.5 million! That indicates guilt if you ask me. Guilt that they got caught. Exactly, when are we getting our hard earned money back?

  8. Velma Lewis says:

I am just wandering when are we going to get our money. I know the bank robbed me of a lot of overdraft fees. I am tired of this extended time frame. I felt that all the one’s who was sent out cards and the ones who filed their claims should have been paid. Now that the file time has passed, when will we get paid. It is time for that bank to pay us once a for all. This is really funny, how the bank take from the people who work hard or don’t have a lot. Why?

  9. Leslie Howard says:

    Hello,
My name is Leslie Howard and I was a long-standing member with Citizens Bank. I left that bank due to their over-draft proceedures and policies. I often called them on this and was told that “This was the way that the bank makes it’s money.” Over the years they took hundreds, maybe thousands of dollars from me this way. I left the bank because of it.

  10. Christian Collado says:

I’ve seen them do this to my account many times over the last couple of years. I’ve always thought it was a blatant ripoff, but I dont have the money to fight a big bank like Citizens.
