A man has filed a Chase robocalls lawsuit alleging JP Morgan Chase Bank violated the Telephone Consumer Protection Act (TCPA).
Plaintiff Pierre A. says he was harassed by the bank’s attempts to collect on an alleged consumer debt, specifically an alleged residential home loan.
Congress passed the TCPA in 1991 because of the large number of consumers who complained about receiving constant telemarketing and/or debt collection phone calls. The TCPA was designed to protect consumers’ privacy and to reduce the number of calls consumers receive that they would label nuisance calls.
According to the TCPA, any person or business who initiates a call to a cell phone using an automated phone dialing system or artificial or prerecorded voice without prior consent from the recipient can be held liable for actual monetary loss or up to $500 in damages for each violation of the TCPA whichever is greater.
If the person or business has willfully and knowingly violated the TCPA the court can increase the damage award up to $1,500 per violation.
Chase Robocalls Lawsuit Allegations
Pierre alleges he purchased a Florida home in late March 2006. At some point during the life of the loan, the servicing of the loan was transferred to JP Morgan Chase Bank N.A.
According to the Chase robocalls lawsuit, the bank began calling Pierre’s cell phone number using an automatic telephone dialing system, a predictive telephone dialing system, and/or an artificial or pre-recorded voice system. Pierre insists he never gave prior consent to Chase to call his cell phone using any of those systems.
Pierre says he received calls between April 2012 and July 2018 from Chase that used one of the methods barred by the TCPA, and each call was made in an attempt to collect the consumer debt. He claims he has received a minimum of 10 such calls, according to his Chase robocalls lawsuit.
Pierre alleges he has experienced “stress, anxiety, loss of sleep, invasion of privacy, and deterioration of relationships, both personal and professional, as a result of the repeated willful and knowing calls placed in violation of the TCPA.”
He also alleges in the Chase robocalls lawsuit that he suffered the following:
- Periodic loss of his cell phone service;
- Lost material costs because of the use of peak time cell phone minutes allowed under his cell phone service contract;
- Expenses including costs and attorney’s fees incurred as a result of the prosecution of this problem;
- Statutory damages.
The Chase robocalls lawsuit also says if the bank contends the phone calls were placed for “informational purposes only,” the bank still did not receive the required prior express written consent needed to place such calls to Pierre’s cell phone using an automatic phone dialing system, predictive phone dialing system and/or an artificial or prerecorded voice.
The Chase Robocalls Lawsuit is Case No. 6:18-cv-01383-RBD-DCI, in the Circuit Court of the 18th Judicial Circuit in and for Seminole County, Florida, Civil Division.

6 thoughts onChase Robocalls Lawsuit Says Calls Violated Federal Law
I am suing Chase Bank/JPM on TCPA violation(s). Does anyone out there know or have the PHONE NUMBERS OR TEXT NUMBERS CHASE BANK USES IN ITS COLLECTION AUTOMATIC TELEPHONE DIALING SYSTEM (ATDS)?
I have my phone records, but, am having difficulty lining up the incoming texts’ numbers. I assume they are en masse’ or batched.
Thank you in advance!
