BlueGreen Vacations sales tacticsBlueGreen Vacations Unlimited Inc. has been hit with a class action lawsuit that accuses the timeshare company of using “hard sell” tactics and misinformation to convince consumers to enter into timeshare contracts.

Plaintiffs Kyle Miles and Jasmine Miles filed the deceptive sales tactics class action lawsuit against BlueGreen Vacations, claiming that the company engages in “the practice of making and advertising false promises and statements with regards to its timeshare contracts that it had no intention of honoring,” causing consumers to suffer damages.

According to the BlueGreen Vacations class action lawsuit, the plaintiffs attended a timeshare presentation for BlueGreen in Las Vegas, Nev., in December 2014.

“The presentation included other high intensity sales tactics to induce Plaintiffs to enter into a timeshare contract, including claiming the presentation would only last two hours when it in fact lasted over five hours in length,” the BlueGreen Vacations class action lawsuit alleges.

During the timeshare presentation, the plaintiffs were reportedly informed that, if they were not satisfied with the timeshare contracts BlueGreen was selling, BlueGreen would buy back the contracts.

The plaintiffs claim they were told by BlueGreen that the timeshare contract would cost only $15,000 over five years at 15.99% interest. However, BlueGreen’s timeshare contract was for $25,000 over 10 years, the timeshare sales pressure class action lawsuit alleges.

According to the timeshare class action lawsuit, BlueGreen also misled the presentation attendees by representing that the timeshare contract’s maintenance fees would not increase, when in reality, the maintenance fees increase on an annual basis.

After the timeshare presentation, the plaintiffs were reportedly taken into a separate room in which a BlueGreen Vacations agent read them the timeshare contract and had them respond, “I agree.” However, the plaintiffs allege that the terms that were actually contained in the timeshare contract are different than the terms promised during the timeshare presentation.

They also claim that they were pressured to open two BlueGreen credit cards and to put the entire $5,000 down payment on the cards.

The BlueGreen Vacations class action lawsuit alleges that BlueGreen’s “false advertising causes significant and continuing harm to consumers who are unable to sell back their timeshare contracts to BlueGreen despite Defendant’s representations.”

By filing the deceptive sales tactics class action lawsuit, the plaintiffs seek to represent a Class of individuals in the United States who entered into a timeshare contract with BlueGreen after BlueGreen made representations about the ability to sell the contract back to BlueGreen. They also seek to represent a California subclass.

The BlueGreen Vacations class action lawsuit asserts claims for violation of the Florida False Advertising Law, the Florida Deceptive and Unfair Trade Practices Act, the California False Advertising Act, the Consumers Legal Remedies Act, and California’s business and professions code.

    How do I join your lawsuit? I agree with all of the claims in the suit above. I recently calculated the fees, etc. I am paying for my 8000 points. They are $1440. I booked 3 days at a hotel using all of my 8000 points. I looked up the actual cost on those days with tax, and it was $798.20. Basically, I was charged $641.80 more than the stay is worth. This should not be legal !

      Let us get together and do this but I am not sure how to get in touch with everyone.
      I am struggling with aren’t of $30,000 because of blue green n would do whatever it takes to get that many back. It is a big scam and we need to stop them.

    My wife and I are in the same boat. We would like to be added to this lawsuit. We are in the process of trying to get out of the contract right now. We have written a letter to BG demanding they release us due to fraud and lying on their part and they have not responded to us. We also just filed complaints with the Florida and Indiana Attorney Generals Offices. Any information on what we need to do to be included in this lawsuit is much appriciated.

    I to would like to be added to this lawsuit. My daughter and I fell for the lies hopeing it would change 3 times. The last was the worst!!! Was told we could sell our points to disney to pay the cost of the loan. With my daughters credit we could consolidate the 3 loan payments to make it affordable. That booking would be easier with more points available.Also got a credit card to pay the deposits. The yearly maintance fee was included in this loan. Now we have. Defaulted on all the loans and our credit is shot.

    I would like to be added to this also. I have read the comments and my experience is very consistent with the other’s here. This company does not just decieve people, they outright LIE to get people to purchase their products. It is really too bad that companies like this continue to operate and succeed. Hopefully they get sued enough to go bankrupt. Then they will experience the feeling that everyone here does.

    I would like to be added to this as well. Attended a meeting in Boyne mountain Michigan. Was told that my shares would never depreciate and we could come back to her and she could sell them for no less than I paid. Went to an “orientation” allegedly to learn how to use my points and it was 4.5 hours of sales pressure. Was told if I bought more points it would open the door to make booking more available. I have yet to be able to book a vacation or an RCI trip. Was lured in by entering a raffle for a side by side at the traverse city mall. We were told a free week no pressure to buy. Only there was pressure and it wasn’t free. I looked at my certificates and I had to pay $100 and mail them within 60 days. At the second meeting I was given 3 “free” weeks on expired certificates. What a scam I have been sick over my decision to buy. How do they live with themselves?

    My wife and i would like to be added to this as well, attended a bluegreen presentation in tennessee, timeshare is not usable, cannot use points to reserve because its “booked” but when calling the same resort i can pay with cash and get the dates i want no problem. Carry over points dont work as explained. Company is nothing but a fraud.
