Blue Shield of California Life and Health Insurance Company is currently facing a class action lawsuit that alleges the insurer breached its Vital Shield policies by expanding stated deductibles and coinsurance/copayment maximum amounts.
The Vital Shield class action lawsuit takes issue with Blue Shield’s practice of not counting commonly used services toward the deductible and copayment/coinsurance maximum, and its practice of excluding those services from coverage until the maximum is met. The plaintiffs allege these practices constitute a breach of the Vital Shield health insurance policies and the implied covenant of good faith and fair dealing. The Vital Shield class action lawsuit also asserts violations of California’s Unfair Competition Law.
In February, a California judge certified a Class of current and former Vital Shield policyholders, excluding former Vital Shield policyholders who did not incur an expanded deductible or coinsurance/copayment maximum.
Blue Shield denies any wrongdoing and maintains that its Vital Shield policies are clear and unambiguous.
A trial for the Blue Shield class action lawsuit has not yet been scheduled.

Class Members of the Blue Shield lawsuit include all individuals who are currently enrolled in or were formerly enrolled in one of the following Blue Shield Vital Shield policies:

NOTE: If you are not currently enrolled in a Vital Shield policy and you did not incur any expanded deductible or co-insurance/co-payment maximum, you are not a Class Member of the Blue Shield lawsuit.
