Blue Buffalo pet foodPet food maker Blue Buffalo Ltd. has been hit with two class action lawsuits accusing the company of fraudulently marketing its products as containing no chicken byproducts, corn or grain. The Blue Buffalo class action lawsuits were filed by consumers and pet food rival Nestlé Purina PetCare Co.

Illinois resident Rachel D. Stone alleges in her class action lawsuit that she purchased Blue Buffalo dog food based on representations representations that it was healthier and did not include certain ingredients. Stone says she purchased  “Life Protection” recipes because of the claim that it contained “NO Chicken/Poultry By-Product Meals,” which was featured prominently in advertisements as well as on the Blue Buffalo website. According to the Blue Buffalo pet food class action lawsuit, however, numerous investigations have indicated that those exact ingredients are in the products.

Stone says that she and other consumers paid a premium for the Blue Buffalo pet food products because they were falsely advertised as a healthier option with better quality ingredients than competing pet foods. As a result, her class action lawsuit alleges that the “representations of the ingredients and nutritional value in its pet food are false, deceptive, misleading and materially incorrect.”

Those investigations were explained in more detail in a similar class action lawsuit filed by Blue Buffalo competitor Nestlé Purina Petcare. Purina alleges that the percentage of poultry by-product is as high as 25 percent and, as such, the company alleges that Blue Buffalo “is concealing the truth about the ingredients in its products.” It also goes on to note that grains and corn are also present.

Both sets of plaintiffs are seeking an injunction requiring Blue Buffalo to modify the advertising of their products, which Purina alleges unfairly target itself and other pet food manufacturers because the commercials say that others are hiding the truth about their ingredients. Further, the company is seeking damages for violations of the Lanham Act based on unfair competition.

Consumers who would form the putative Class of Illinois or nationwide buyers of Blue Buffalo pet food products are seeking damages under violations of the Illinois Consumer Fraud and Deceptive Business Practices Act for the subclass and other states for the class of all buyers in the United States.

The Blue Buffalo Pet Food Class Action Lawsuit is Rachel D. Stone, et al. v. The Blue Buffalo Company Ltd., Case No. 14-cv-00520, in the U.S. District Court for the Southern District of Illinois.

The competitor’s class action lawsuit is Nestlé Purina PetCare Co. v. The Blue Buffalo Company Ltd., Case No. 14-cv-00859, in the U.S. District Court for the Eastern District of Missouri.

UPDATE: Blue Buffalo has announced that it will pay $32 million to settle the pet food class action lawsuits.

    Purchased this food multiple times I fed this food to new 6 week old puppies because Petsmart swore it was the best good like an. Idiot I continue to buy it throughout their adults lives

    We have had our dog on Blue Buffalo Salmon and Sweet Potato for over a year with no adverse effects. As I read these replies, it occurs to me that many of the respondents might well look into the difference between correlation and cause-and-effect.

    Tim I also live in GA and had a terrible incident with my otherwise healthy male catI put in a so called medical claim, but they wont even return the thousands of dollars I spent on their crappy food, which would help pay the vet bill.Do you know how to join the class action??? Thanks

    in case you havent noticed JOE, America has become the home to GREED at the cost of the health and welfare of its citizens and the FDA and the USDA allow it. There are ingredients in food here not allowed in some countries, this is becuase the USDA, FDA and Big Pharma all pay them off. If you are happy with Blue good fo0r you, but watch out, its not going to happen in a week, it may not happen in a year, or at all in your dog. Blue advertises that they do not contain certain ingredients yet they do its FALSE ADVERTSING at the expensive of the health of our pets for their profit, I would hardly say this is a case of ambulance chasing. My cat endured pain beyond beleif and almost died. BLUE SHOULD PAY!!!!!! Why are you on this site if you are happy with them anyway.

    I took three days gathering information to put in my claim to Blue as I thought it was a big waste of time, they wont pay my 3200 vet bill after my very healthy young cat obstructed and I had the vet do an emergency surgery to save his life. I d=fedd him Blue Buffaloe basics for years, 6.5 years in fact. I hope they rot in hell.Can someone please tell me how to join in the class action suit???

    My little Louie has been having IBS vomiting and bloody loose stool for months . The issue only started when using this dog food. The ironic thing is we switched him to the basic small breed formula because it had limited ingredients and paying a premium to have my baby healthy was fine with me. To find out I was paying extra money to feed him something that was hurting him. Its awful. If anyone has any idea how to join this class action suit please let me know. Sarahwilson.cpnn@gmail.com . Its not about the money. These are our babies and we entrusted blue buffalo to care for them. This is horrible.

    I began feeding my cat BB after she was diagnosed w lymphoma (cancer) because it claimed to not have by products. By products are linked to cancer so I wanted to be extra safe. Now with all of these new discoveries I am PISSED!!!!!! I put my cat through chemo for over 2 years and am trying to do everything in my power to prevent it from coming back, including feeding what I thought was the best food out there. All I can do is shake my head, and stop feeding this food to my babies. Very disappointed!

    I fed my two cats the blue basics for several years because I thought they where a healthy choice for food, one cat developed an allergy and her hair fell out on her tail the other after a whoping 3000k surgery for constant Crystal blockages. STAY WAY FROM THIS FOOD!!!!! I now have them on natures variety instinct both dry and can ans so far so good lots of improvement. Blue you stink!!! You should have to pay my vet bill!!! Oh they also have so much potato starch they will make cats obese!!!

    We purchased blue buffalo for years for both our dogs, paying premium prices because we believed we were getting premium food for our babies. I feel ripped off and I believe that it caused skin issues in one of my dogs and probably is the reason he now has to take daily medications for heart damage. I too would like to know how to join this class action lawsuit.
