Biomet Orthopedics faces a new Biomet M2a Magnum hip implant lawsuit in Indiana federal court over allegations that the device’s implantation caused severe adverse side effects and injuries.
Plaintiff Donald L. files the Biomet M2a Magnum hip implant lawsuit demanding jury trial. The lawsuit was filed on July 25, 2018.
According to the Biomet M2a Magnum hip implant lawsuit Donald, a resident of Virginia, says that he was implanted with the M2A-Magnum Hip Replacement System during a procedure to replace his left hip on Aug. 23, 2007. However, soon after the device’s implantation he says he suffered “increasingly debilitating pain, discomfort, soreness, dysfunction, and loss of range of motion.”
As a result of the Magnum device implantation, he says that he also suffered other personal and economic injuries such as lost wages and future loss of earning capacity and incurred medical expenses. Due to adverse side effects he suffered after undergoing the procedure, he subsequently had to undergo revision surgery to replace the Magnum hip implant.
According to the Biomet M2a Magnum hip implant lawsuit, “Had plaintiff or Plaintiff’s surgeon known that the Magnum Device caused injury and had the potential to require revision surgery to remove the device, with no benefit over traditional hip implants, then neither Plaintiff nor Plaintiff’s surgeon would have chosen the Magnum Device for the hip implant surgery.”
The Biomet M2a Magnum hip implant lawsuit was filed on multiple counts including design defect, failure to warn, breach of express warranty, violation of the consumer protection laws, negligence, negligent misrepresentation, and breach of implied warranty.
Overview: Biomet M2a Magnum Hip Implant
The Biomet M2a Magnum is a metal-on-metal hip implant with a history of serious injuries and complications. The issues reported by patients are the result of the “ball” or metal head of the device and the metal cup rubbing together and releasing cobalt and chromium particles. Health problems linked to the metal particles may include:
- Tissue death
- Pseudotumors
- Pain and burning
- Vision loss
- Heart damage
- Dementia
- Elevated blood metal levels
Steps to take for patients who have been implanted with a Biomet M2a hip implant may include seeing a physician for a follow-up exam. Patients can ask their orthopedic surgeon about research regarding metal-on-metal adverse effects, like metallosis, tissue death, and pseudotumors linked to Biomet M2a hips.
Patients can also request a CAT scan and MARS MRI to look for adverse side effects and pseudotumors that may have come about from the implant. Blood tests for chromium and cobalt particles can reveal a sign of metallosis, which can lead to even more serious complications and injuries.
Last, it is recommended to consult an attorney prior to any revision surgery procedure if possible. It may be essential to preserve Biomet M2a metal-on-metal hip replacements for evident to be used during litigation.
The Biomet M2a Magnum Hip Implant Lawsuit is Case No. 3:18-cv-00563, in the U.S. District Court for the Northern District of Indiana, South Bend Division.
