BidRack.com Scam Class Action Lawsuit

By Matt O’Donnell

BidRack
A federal class action lawsuit claims that penny auction website BidRack.com deceptively markets and bills customers for unauthorized charges to its “free” site by charging them $60 to $99 for registration, which it advertises as “completely FREE!”
The BidRack class action lawsuit alleges consumers are “bombarded with advertisements and other representations urging them to register for ‘free.’ However, defendants fail to conspicuously disclose, and in fact, actively disguise the actual cost of registration and membership…. consumers who register on the site do not affirmatively choose or know that they are being charged for an initial ‘bid pack.’”
In addition to using deceptive advertisements to lure customers to BidRack.com, the BidRack class action lawsuit says the company posts fake news articles and customer reviews on its website and places fraudulent postings on Craigslist.org, a popular online classifieds website.
“All of these fraudulent advertisements exist solely for one purpose — the drive unsuspecting consumers to Defendant BidRack.com’s auction website, and specifically make them believe that they can register for free and buy items for little more than pennies,” the class action states.
The BidRack scam class action lawsuit is brought on behalf of all U.S. residents who were charged for a bid pack during the BidRack.com registration process by Defendant BidRack, Inc. It is also seeking to represent a subclass of California residents who were charged for a big pack and all U.S. residents who were directed to a BidRack.com landing page and were charged for a bid pack. It is seeking an award of all economic, monetary, actual, consequential, statutory and compensatory damages caused by BidRack’s conduct, in addition to other relief.

Wow, just now found out about the suit against bidrack.com I too want to know if it is too late to get in on the suit, not only did they take the hundred dollars out of my moms account, but i noticed everytime she would win an auction they started charging her more just for winning. Then I think we only received one spongebob watch that wasn’t worth 50 cents. We won (lost) way more than that by the items we never received, and I got to watching and they were charging her .50 cents for every bid she made.

I jusead about the class action. Whis I had knon , is it to late to get in on it? BidRack charged my card without autherization. I have had not been able to even talk to a person about it, They just say it was an approved amount and there is nothing I can do. I’m so glad someone is holding them accountable.

I have purchased bids on Bidrack and won several items: a ring and several gift cards for Target, Best Buy, Applebees. After I won, I paid for these items and have never received anything.

When I call their customer service number, I am on hold forever and never get to a rep. Last time I called I hung up after 30 minutes. However, when I emailed them, I did get a response.

Their reply was that their previous supplier did not send them the gift cards and that they would credit my account with bids equal to the amount I paid for them items. I told them that this was unacceptable as they currently had the same gift cards on current auctions and that I did not want anymore “bids” credited to me, I wanted the items I won and purchased. I held up my end of the deal why can they not do the same. Pretty much got no where with them and still no items sent to me.

Like the others, I never received merchandise “won”, and encountered the run around. Does anyone know how we actually join the class action lawsuit against BidRack/Nomorerack?

I would love to be part of this, they are a joke. I sent this to the BBB and the BBB told me they never replied and when I send them emails, I get the runaround, it will take a while but I have been hearing that since May.

I was charged $99 for free registration. Called and emailed them for a month trying to get a refund. To this day I have not used a single bid. I read an article when I was researching this site, and they were rated A+, so I thought they were an honest site. I want to be part of this lawsuit.

I call them and they said oh they are make mistake, will sent in few months but been for along already. As the mean time I was believe in them and stupid refer to my sister. She was spent few hundred bucks and was paid lot of money for shipping and never receive anything.

was also charged the 99.00 when it said “free” registration.
Also won a bid for a dress back in April and still haven’t received it. I filled out refund request and still get the run around when I ask where my refund is. Now they have taken their phone number off the site (I had it written down) when I try to call the number I get a message that the phone line is down and they’re working to get it BACK IN SERVICE…NOT! It’s been like that for awhile! These are very shady characters and I would like to join the lawsuit.

I want in on the class action law suit. I have pages of correspondence with bidrack and it clearly shows me getting the runaround. bidrack lies and does not follow through with promised products that you so called “win.” i feel i should be compensated for the bid rack pack i bought, the price i paid for “won” items, the shipping and handling charges that were already taken right out of my bank account, as well as the retail cost of said won items so that i may replace what i thought was mine!

I was also charged $99.00 unknowingly. I put in my cc number just to see the site but after reading posts if how bad they were I backed out of the cc info. Still they charged me $99.00. I never saw a confirmation that $99.00 would be charged and in fact thought I got out before any final button was pushed. I want to be included the the class action suit. To this day I’m not sure how I even got on there site! I just wanted to be a lookie-lou and was charged $99.00. Never did any bidding as I say I just wanted to back out of any information I gave them.
