UPDATE: On July 8, 2019, a proposed $11.9 million settlement was reached between computer company ASUS and its customers who allege that their laptops’ battery life was less than stellar, causing them to overheat. 


The makers of ASUS ROG Strix GL502VS and GL502VSK laptops have been hit with a class action lawsuit over alleged defects in the battery that reduces power and accelerates degradation of the battery.

Lead plaintiff Joseph Carlotti alleges in his class action lawsuit that ASUS Computer International and ASUSTEK Computer Inc. highlighted the powerful graphical processor suited for gaming and video editing in marketing the laptops.

However, alleges the plaintiff, the laptops contain a uniform defect in their battery that the companies refuse to fix.

Carlotti says that he purchased an ASUS GL502VSK prior to a two-month trip abroad. He claims that he could feel the heat emanating from the laptop keyboard during that trip and the graphical performance suffered.

After months of wrangling, Carlotti says that the repair and subsequent replacement laptop he was sent also suffered from the same defect and became inoperable, according to the ASUS laptop class action lawsuit.

“As a result of consumer complaints from owners of the Laptops, which suffered from the power defect, Defendants distributed at least two software updates, nether of which remedies the Power Defect,” alleges the ASUS battery defect class action lawsuit. “Defendants also repeatedly promised – and then failed to deliver – a permanent hardware fix for the Power Defect, apparently because they found prohibitive the cost of providing laptops that performed as represented.”

The plaintiff says that the power defect has three consequences: the laptops’ battery drains during use even when connected to an electrical outlet; the laptops suffer from significant reductions in performance when low on battery; and the degradation of the battery occurs more quickly than it should.

According to the ASUS computer class action lawsuit, the makers of the ASUS ROG Strix GL502VS and GL502VSK laptops affected by the alleged defect have refused to provide a solution. Carlotti says that in addition to the ineffective software updates, the replacement parts offered are similarly defective and do not solve the problem.

The plaintiff accuses ASUS and ASUSTEK of misrepresenting the cooling systems in the ASUS ROG Strix GL502VS and GL502VSk laptops to consumers. The powerful components in the laptops generate a great deal of heat, says the plaintiff, and complex cooling systems are necessary – especially during intense gaming sessions.

The cooling systems are not independent as advertised, alleges the ASUS class action lawsuit. Additionally, the “stability” touted by the laptop makers is not present, allowing the devices to run much hotter than competitors’ laptops, Carlotti claims.

The plaintiff seeks to represent a nationwide Class of consumers who purchased either of the ASUS ROG Strix GL502VS or GL502VSK laptops, as well as a California subclass.

According to the ASUS class action lawsuit, the laptop makers breached express and implied warranties, violated California consumer and advertising laws, and fraudulently concealed the alleged defect.

The plaintiff is seeking monetary relief, including actual and punitive damages, as well as an injunctions and equitable relief.

    My battery is swelling too. Deforming the metal case really bad. I hope it doesnt blow up, these lithium batteries can be really dangerous.
