Arizona Iced Tea “All Natural” Class Action Lawsuit Certified
By Matt O’Donnell
A federal judge on Tuesday partly certified a class action lawsuit claiming Arizona Beverages falsely advertised its iced tea drinks are “all natural” even though they contained high fructose corn syrup.
The Arizona “all natural” iced tea class action lawsuit was filed in 2010 by lead Plaintiffs Laruen Ries and Serena Algozer.
U.S. District Judge Richard Seeborg said the plaintiffs sufficiently alleged they relied on the “all natural” advertising claims in their decision to purchase the Arizona iced tea beverages and felt deceived when they later learned those claims were not true.
Judge Seeborg said the proposed class can move forward to seek declaratory and injunctive relief, including their pursuit of a corrective advertising campaign or to have the company top the allegedly deceptive labeling practices. However, Seeborg denied class certification for claims seeking monetary damages, including restitution, reimbursement, refund and disgorgement.
The newly certified Arizona iced tea class action lawsuit includes all California residents who purchased an Arizona brand beverage from March 17, 2006 until the present that contained high fructose corn syrup or citric acid and which were marketed, advertised or labeled as being “all natural,” “natural” or “100% natural.”
The Arizona Iced Tea All Natural Class Action Lawsuit case is Lauren Ries, et al. v. Hornell Brewing Co., Inc., et al., Case No. 10-cv-01139, U.S. District Court, Northern District of California.
The plaintiffs are represented by G. Richard Baker of Baker Law PC, by Joseph L. Tucker of Jackson & Tucker PC, by Kevin P. Roddy, Philip A. Tortoreti and Daniel R. Lapinski of Wilentz Goldman & Spitzer PA, and by David M. Lilienstein of DL Law Group.

i which from buying soda drinks to the arizona tea thinking it was good for me, mainly buying the GREEN TEA with GINSENG an HONEY because I thought that was all natural, but I read this an again I’m shaking my head at this company for false adverting. I’ve been fooled again, I would like to know how I can file for this class action so I can retrive some of the money I have spent on the years buying this TEA thinking I’m putting something all natural in my body.
How do I file a claim to be part of this clas action lawsuit?
Bad business to fasely fool consumerd
I feel that not fair for others to false advartise that arizon is all natrual. Companies will say anything to be richer and richer.
