ADT LogoA Georgia resident has filed a lawsuit against ADT alleging that the home security company violated the Telephone Consumer Protection Act, otherwise known as the TCPA.

Plaintiff Deborah F. states in her ADT TCPA lawsuit that in March 2016, she began receiving calls on her cell phone from ADT. In these phone calls, ADT was seeking a third party unknown to Deborah.

Since mid-March until the time of filing her lawsuit, Deborah states that she has received at least nine similar phone calls.

As she received the phone calls from ADT, Deborah expressed that she advised ADT that the company was calling a wrong number as it attempted to collect a debt. She requested to stop receiving phone calls.

When she received the phone calls from ADT, Deborah said that she heard pauses and/or clicks followed by a delay at the beginning of the calls, and believes that ADT used an autodialer and/or predictive dialing equipment in order to place calls to her.

Deborah says that she never provided consent for ADT to contact her on her cell phone, and explicitly revoked any implied consent as she continually told the company to stop contacting her.

According to the ADT TCPA lawsuit, “Defendant used multiple outgoing phone numbers to contact Plaintiff, making it impossible for plaintiff to block and/or avoid the calls. Moreover, plaintiff was unable to avoid or escape Defendant’s repetitive calls.”

Deborah says that these calls from ADT “have interrupted and interfered with Plaintiff’s daily life, including activities of daily living, interactions with family and friends, and work activity.”

Deborah has considered these phone calls as harassing and alleges that these phone calls have caused her actual damages, “including, but not limited to the consumption of ‘minutes’ as contemplated in her cellular service plan that has the end result of Plaintiff paying for the calls initiated by the Defendant, depletion of Plaintiff’s battery life resulting in diminished preferred usage by Plaintiff, emotional distress – including frustration and aggravation – in managing the persistent calls, and the expenses associated with seeking to enforce Defendant’s compliance with the law.”

Deborah has brought forth two counts against ADT including violations of the Telephone Consumer Protection Act and violations of the Georgia Fair Business Practices Act.

Deborah is seeking recovery of damages under the TCPA in the amount of a minimum of $500 for each call plus triple damages for “Defendant’s knowing and/or willful violations of the TCPA.”

She is also seeking actual damages, general damages, exemplary damages and reimbursement for reasonable attorneys’ fees and costs as well as any additional relief deemed appropriate by the Court.
