A class action lawsuit claims that Ocean Spray cranberry juice blends contain artificial flavoring despite packaging that states “No High Fructose Corn Syrup, Artificial Colors or Flavors.”

Plaintiffs Michael Froio and Mikhail Surman say several cranberry juice blends manufactured and marketed by Ocean Spray Cranberries Inc. include chemically manufactured malic acid and fumaric acid in order to create sour, tart tasting beverages.

The Ocean Spray class action lawsuit states that by including these unnatural and synthetic ingredients, the company is misleading reasonable consumers who are willing to pay more for products labeled as being naturally flavored.

“Consumers have become increasingly interested in foods, cleaning products, bath and beauty products, and everyday household products that do not contain synthetic or chemical ingredients,” the Ocean Spray cranberry juice blends class action lawsuit alleges.

Juices covered in this Ocean Spray class action lawsuit include: Ocean Spray Cran Cherry Flavor 100% Juice, Ocean Spray Cranberry Juice Cocktail, Ocean Spray Cran Pineapple, Ocean Spray Cran Pomegranate, Ocean Spray Diet Cran Pomegranate, Ocean Spray Cran Grape, Ocean Spray Cherry, Ocean Spray Diet Cran Cherry, Ocean Spray Wave Berry Medley, Ocean Spray Cran Apple, Ocean Spray Wave Apple with White Cranberries and Ocean Spray 100% Apple Juice.

The plaintiffs claim that they both bought a variety of these Ocean Spray juices over the past few years after reading the front label that confirmed the juices contained no artificial flavors or colors.

In addition, Surman and Froio say that the images of water, fruits and fields on the front of the juice bottles “reinforced the impression that the Products did not contain artificial or synthetic colors or flavors.”

According to the Ocean Spray juice class action lawsuit, shoppers are unable to verify if all the ingredients listed on a package are in fact natural or artificial. The plaintiffs say consumers must rely on product labels when making a purchase.

“Moreover, consumers are not expected or required to scour the ingredients list on the back of the Products to confirm or debunk Defendant’s prominent front-of-the-packaging claims, representations, and warranties that the Products contain ‘No High Fructose Corn Syrup, Artificial Colors or Flavors,'” the Ocean Spray class action lawsuit states.

Froio and Surman say they would not have paid as much as they did for the Ocean Spray cranberry juice blends if they had known the beverages included synthetic ingredients.

However, the Ocean Spray cranberry juice class action lawsuit alleges that the plaintiffs would purchase these juices in the future if the company agreed to comply with their label statements and did not include any unnatural flavoring.

The Ocean Spray juice consumers are represented by David Godkin and James Kruzer of Birnbaum & Godkin LLP, L. Timothy Fisher and Joel Smith of Bursor & Fisher PA, and by Reuben Nathan of Nathan & Associates APC.
