Lawsuit Alleges Luxury Condos Contaminated with AsbestosA new lawsuit alleges that luxury condos were contaminated with asbestos.

According to the lawsuit, the owners of an Upper East side building in New York City knowingly sold apartments contaminated with asbestos to residents, without disclosing the contamination to the buyers.

Half a dozen residents living in the building claim that they paid a premium price for homes in the building staffed by a door man, only to be deceived when those rental apartments were converted to condominiums in 2015. Further, the company that transitioned the apartments to condominiums allegedly knew that the buildings were contaminated with asbestos.

The asbestos, lawsuit, filed in Manhattan Supreme Court, says that the company is responsible for purposefully selling a dangerous building contaminated with asbestos and encouraging the residents living in the building to purchase something that could expose them to serious health risks.

As explained in the lawsuit, the offering plan included claims that the homes were asbestos free. However, some of those homes contained a substance called mastic under the wooden floors. Mastic, according to the plaintiffs, contains asbestos.

The residents bringing forward the lawsuit claimed that the building contaminated with asbestos underwent renovations without any special procedures related to asbestos removal.

One of the couples involved in the lawsuit says they paid nearly $3 million for their apartment under the assumption that it was newly renovated and asbestos-free. However, now they, and other residents in the building who claim that they were put at risk due to the floors being possibly contaminated with asbestos, believe that they have sustained damage.

These residents argue that knowing that they are living with a deadly substance is extremely dangerous and that the company should have informed them about the asbestos risks prior to following through on the sale.

The lawsuit filed over the building allegedly contaminated with asbestos says that the defendants were well aware of the fact that there was asbestos in the property that had not been appropriately removed at the time that the clients entered into contracts for the luxury condominiums.

Asbestos exposure over a long period of time has been tied to a number of different medical conditions, including lung cancer and mesothelioma. Buildings contaminated with asbestos can expose everyone living inside to serious dangers.

Although many asbestos lawsuits have been associated with workplaces, like shipyards or factories in which asbestos was used in the construction of the facilities, any building contaminated with asbestos poses health risks for people working or living inside of them.

Unfortunately, any area contaminated with asbestos can expose residents, workers or anyone else in the area on a regular basis to dangers including medical conditions like mesothelioma and lung cancer, which can be serious or even terminal.

These conditions often have a long latency period — meaning that living in a home contaminated with asbestos could expose owners of the home and children to dangerous medical conditions years after their initial exposure.
