A woman from New York filed a personal injury claim against a Connecticut resident, after sustaining a serious car accident injury that severely affected her life. She alleges the car accident injury left her either temporarily or permanently disabled and has caused her to miss work while medical bills continue to pile up.

According to the personal injury claim, plaintiff Beatriz C. sustained the car accident injury as a result of the negligent driving of Thomas Gordon. This car accident injury has forced Beatriz to undergo numerous expensive medical treatments, including rehabilitation therapy and any hospitalization treatments, the complaint alleges.

The car accident in question reportedly occurred on July 11, 2016, in which Beatriz was driving westbound on the Long Island Expressway at or near the intersection with Utopia Parkway in New York. At this intersection, Beatriz says she was driving her 2012 Honda and was allegedly struck by Gordon’s 2014 Chevrolet and suffered at least one serious car accident injury.

Gordon was reportedly driving in a dangerous and negligent manner, which caused the collision and left Beatriz with serious injuries. According to the personal injury lawsuit, Beatriz suffered a serious car accident injury and has been forced to undergo rigorous medical treatment for the physical and mental impairments caused by the car accident.

Beatriz filed this personal injury lawsuit after discovering that Gordon allegedly drove in a dangerous manner, which ultimately led to the collision.

Overview of Personal Injury Allegations

Car accidents are one of the most common occurrences that spur a personal injury lawsuit, as they often involve serious injuries and expensive property damage. The injured party will most likely face extensive medical bills and may miss work due to the recovery process, and they may even suffer permanent disability.

Even if permanent disabilities do not occur, the injured person’s life will be severely impacted and will most likely face a diminished quality of life. This was allegedly the case with Beatriz, who says she is still contending with present and future medical bills from the crash.

Personal injury law generally addresses disputes that occur when one person sustains injuries from an incident that could have been reasonably prevented. Personal injury laws vary by state, but these policies create a general pathway in which the injured party can seek compensation for their damages.

Many personal injury claims are resolved through civil court proceedings, while other are settled before a lawsuit is even filed. How they get resolved may depend on the severity of the injuries suffered and how easily negligence can be proven, in which New York and other states have different standards of proof.

This can either make the filing process easier or more difficult depending on the surrounding circumstances, so potential claimants should document as much evidence as much as possible. Most eligibility requirements for a personal injury claim are centered on these three questions:

  • Did the incident cause physical or psychological injuries?
  • Was the incident caused by negligent actions of the other party or entity?
  • Are the damages recoverable?

Beatriz is seeking all relevant damages for her car accident injury, stating that Gordon’s negligible driving caused the collision.

This Car Accident Injury Lawsuit is Case No. 1:18-cv-04932-JBW-RML, in the Supreme Court of the State of New York, County of Queens.
