Couple Says Vegas Parking Lot Accident Caused Personal Injury in Hertz LawsuitA Brazilian couple living in Nevada says that they suffered personal injuries in a parking lot accident due to excessively large lanes in the Hertz lot at the Las Vegas airport.

According to the personal injury lawsuit, the couple got into a parking lot accident due to the negligence of another driver that was on the company’s property.

Plaintiffs Isabel A. and Carlos F. had previously lived in Nevada in a domestic partnership, and are filing legal action in the United States because Hertz is based in the same state.

The alleged parking lot accident occurred at the McCarran Airport in Las Vegas. The plaintiffs say that on the day of the accident, Jan. 1, 2017, they arrived at the Hertz location in the airport. During this time, they had returned the car they had rented and followed procedure by parking the car in the designated lane. After they had returned the car, but were still standing in the return lane, they say there were struck by another driver trying to pass them.

Overview of Personal Injury Lawsuit

The personal injury lawsuit alleges that Isabel and Carlos were standing between two lanes of cars that were stationary and were also being returned. The other driver, Robert Stevens, allegedly tried to drive in between the lanes, thinking he had enough room to pass. Stevens is also named in the personal injury lawsuit and is a resident of California. Stevens was reportedly returning a 2017 Hyundai Sonata, when he allegedly struck Isabel and Carlos and caused them serious injuries.

Isabel says she was thrown into the air and onto the concrete floor of the Hertz location due to the force of the parking lot accident. The personal injury lawsuit alleges that Stevens accelerated when he should have braked, causing her to be hospitalized in Las Vegas and later on in Brazil.

Isabel alleges she sustained permanent physical and emotional injuries, solely caused by the parking lot accident. According to the personal injury lawsuit, Stevens was able to strike Isabel due to the design of the parking lot and how wide the return lanes were.

The claim states that the Hertz return lanes were excessively wide, allowing Steven’s car to pass through the other cars and cause the parking lot accident.

Carlos further attests to the severity of Isabel’s injuries, stating he was near her when she was struck. As a result, Carlos says he developed severe emotional damage that will most likely impact him for the rest of his life. It is important to note that Carlos and Isabel had traveled to Los Angeles and Las Vegas for a vacation, and had no reason to believe they were at risk for getting involved in a parking lot accident.

At all times relevant, Hertz was responsible for maintaining a safe environment for employees and customers. This includes confirming that the return lanes of their parking lot were reasonably sized, which would have helped prevent the parking lot accident described in this personal injury lawsuit.
