Getting a Disability Insurance Lawyer for an Unum Claim DenialA man from California has recently filed a claim denial lawsuit and has begun working with a disability insurance lawyer, alleging the disability provider had wrongfully denied his claim for benefits.

A disability insurance lawyer will help guide this claim denial lawsuit through the litigation process, and may increase the likelihood of a successful outcome for the plaintiff in this case.

Plaintiff Adam F. alleges he was entitled short term and long term disability benefits from Unum through his employer, but had to consult a disability insurance lawyer after being forced to file legal action.

According to the claim denial lawsuit, Adam was fully employed by Square Inc. but forced to stop working when he became disabled on April 1, 2016. Adam says he filed for long term disability benefits soon after being declared disabled, but Unum denied his claim on June 1, 2017.

Adam says he filed an appeal, but was once again denied on Feb. 20, 2018. Adam alleges he continued to try and prove the severity of his condition to Unum. According to the claim denial lawsuit, Adam provided proof that he had been awarded Social Security Disability Benefits on May 14, 2018 and Unum was quick to respond a day later.

Unum responded by stating it had completed a full review of his claim on Feb. 20, 2018, and that no further review was available.

Overview of Claim Denial Allegations

According to the lawsuit, Adam has been unable to work since he became disabled on April 1, 2016 and was unable to earn a sufficient income. In order to be deemed completely disabled by Unum, he says, the policyholder must be completely unable to perform their occupational duties, be unable to find work in a similar industry, and lose a significant portion of their income.

Adam allegedly experienced each of these, but had still been denied long term disability benefits. At this point in time, Adam has exhausted all administrative remedies and has been forced to file legal action.

Adam is working with his disability insurance lawyer to seek compensation for all missing long term disability payments along with any other relevant damages.

Unum Life Insurance Company of America is one of the oldest and largest disability insurance providers in the United States, but has garnered public criticism for allegedly using unfair claim denial tactics when evaluating claims.

This has forced numerous policyholders to file legal action and seek out their own disability insurance lawyer, or contract one when filing a claim as a preventative measure. People who are considering seeking out a disability insurance lawyer to file their own claim denial lawsuit, may consider taking the following steps:

  • Review their insurance contract to see if the company is in violation of their policy contract
  • Gather all the documents relevant to the claim, including photos, reports, receipts, estimates, and other correspondence with the insurance company
  • Document the claim denial, and request that a supervisor at the insurance company review the claim and denial
  • Send a written demand letter detailing the claim and make sure to get a return receipt when mailing
  • File a complaint with the state’s department of insurance
  • File a bad faith insurance lawsuit
  • Work with a disability insurance lawyer

This Claim Denial Lawsuit is Case No. 2:18-cv-05269, in the U.S. District Court of Central California.
