durapro-toilet-connectorInterline Brands Inc. has agreed to pay $16.5 million to settle a class action lawsuit alleging the company’s DuraPro Toilet Connectors have a defective part that can lead to flooding, causing damage to homes.

The proposed DuraPro class action settlement would resolve allegations that the coupling nuts of the DuraPro toilet connectors, which connect the water supply to the toilet, are defective and unable to handle the stress during installation.

The coupling nut develops a circumferential fracture which allegedly allows water to flow into homes and cause property damage.

According to the DuraPro toilet connector class action lawsuit, Interline received the allegedly defective toilet connectors from China between 2002 and 2013, but failed to test them prior to distributing them to consumers.

Interline employees knew about the alleged DuraPro toilet connector defect since at least 2007, the DuraPro class action lawsuit alleges.

Plaintiff Jacquelyn Ajose filed the DuraPro class action lawsuit in August 2014 on behalf of herself and a proposed Class that would include anyone who owned or leased a structure with a DuraPro toilet connector, or anyone who experienced property damage from the alleged DuraPro toilet connector defect. Additional lead plaintiffs were subsequently added to the complaint.

Interline denies that the coupling nuts of its DuraPro toilet connectors are defective and sought to have the toilet connector class action lawsuit dismissed. The plaintiffs filed a motion for Class certification in February 2017, which was granted, and the parties engaged in mediation later in the year, which resulted in the proposed DuraPro settlement.

According to the DuraPro class action settlement documents, Interline has agreed to reimburse Class Members $4 per replacement toilet connector, up to five toilet connectors per residence or other structure.

Interline will also provide compensation to Class Members who suffered property damage due to the failure of the coupling nut. Property damage compensation will be at least $4 but not more than 30 percent of the costs associated with property damage. To qualify for this benefit, Class Members must submit a valid claim and establish that they have experienced property damage from the failure of a coupling nut on a DuraPro toilet connector.

The plaintiffs have asked a Tennessee federal judge to preliminarily approve the DuraPro class action settlement.
