Plaintiff Karin D. filed the construction personal injury lawsuit in New York federal court. According to the construction personal injury lawsuit, the complaint revolves around an incident that occurred on Feb. 18, 2018. Karin is a citizen of the country of Canada. Other named defendants include Triumph Construction Corp. and Consolidated Edison Company of New York, Inc.

According to the construction personal injury lawsuit, an employee of Fairway was operating a forklift on a street corner of W. 74th St. and Broadway in New York City. At this location, there was a street opening and excavation that was at least five feet wide, five feet long, and at least five feet deep, the complaint says.

Karin says the forklift that was being operated by the employee came into contact with one of the metal plates located at this location, causing it to move. This led to the opening of the excavation and causing Karin to fall into it, she claims.

According to the construction personal injury lawsuit, Karin suffered severe personal injuries. Some of these injuries included a left ankle fracture, causing her to be unable to bear any weight, undergo physical therapy, and required her to bear a cast and crutches, the lawsuit states. Other injuries included head trauma, vertigo and dizziness from the fall, mental anguish, distress, pain in the right shoulder, left knee scrapes, and pain in the right thigh.
