Spirit_AirlinesSpirit Airlines Inc. has been hit with another class action lawsuit accusing it of falsely advertising the prices of its tickets then nickel-and-diming customers for necessary services.

Plaintiff Nikki Giavasis alleges Spirit Airlines deceptively represents that its airfares are the lowest available on the market.

According to the Spirit Airlines class action lawsuit, the airline fails to disclose that consumers will be charged higher prices for baggage services and snacks than competing airlines charge, “thereby making any apparent savings illusory.”

Consumers purchase Spirit Airlines tickets through third-party retailers such as Orbitz.com, where the tickets are advertised as being the lowest airfare on the market, the Spirit Airlines class action lawsuit says.

“Nowhere in Defendant’s advertisements are consumers notified that they will be charged excessively for services that are related and necessary to airline travel,” Giavasis alleges in the Spirit Airlines class action lawsuit.

Giavasis says that costs of service such as baggage fees, seat selection and ticket printing are important to consumers when they make a decision about which airline to choose. She claims that Spirit Airlines advertises its air transportation as costing less than its competitors when in some cases, the fees for important services cause the consumer to pay more for travel than they would have if they had purchased airfare from a competitor.

Spirit Airlines reportedly does not disclose the costs of services until after a customer purchases tickets and conceals the fact that the price of the tickets do not include services that are often included as part of its competitors’ ticket prices.

Giavasis says that she purchased Spirit Airlines tickets in December 2016 through Orbitz.com, believing that she would save money by choosing Spirit Airlines over its competitors. When she attempted to check in online for her flight, she was informed that she had the “option” to pay to check bags, print tickets and select seats.

According to the Spirit Airlines class action lawsuit, the costs of paying for these services “annihilated” any savings she obtained by choosing Spirit Airlines over competing airlines. Giavasis says she felt “ripped off” and “cheated” by Spirit Airlines’s allegedly deceptive ticket pricing model.

“Defendant’s sale of ‘optional’ Attendant Services, which are in fact required and made available for no cost by competing airlines, were made available only after Plaintiff purchased tickets,” which, according to the Spirit Airlines class action lawsuit, “shows that Defendant knew that Plaintiff, as well as similarly situated consumers, did not know the true cost of airfare.”

The Spirit Airlines class action lawsuit was filed on behalf of Giavasis and a proposed Class of California citizens who purchased Spirit Airlines tickets in California and whose tickets were advertised as being the cheapest available.

Giavasis accuses Spirit Airlines of violating the California False Advertising Act and the California Unfair Business Practices Act.

Spirit Airlines was recently hit with a similar deceptive airfare pricing class action lawsuit in New York federal court.

    In February 2022, I purchased a roundtrip ticket from New Orleans, LA to Atlanta, GA for my granddaughter. She had one small bag 12X22 which she was able to bring as a carryon but was denied by Spirit to allowed to come back as a carryon without paying $100 for the same bag. As a student she did have the $100, so we could I pay with a credit card over the phone, denied, could she leave the luggage, denied. Spirit representative advise was to throw in the trash as they laughed. I have pictures of the luggage and her in the airport. As well as I was on the phone with her during the entire time.

    practically impossible to get a simple answer. Spirit misleads you into thinking your getting best price to fly , especially if you pay to join supersaver. says u can bundle your trip, then you do that and they dont say you pay for each flight, going and return, it says your trip, deceptively then charged for 2 bundles on a round trip, plus super savor, leaving me paying easilly 70.00 more then my friend on same plane no bundle nor supersavor, .

    This is the 1st time my husband & I used this airline. I will never use them again! Don’t get side tracked with the low cost ticket. We got tagged with $300 extra for luggage. They charge extra too for carry on luggage. It seems like the luggage weight limit authorized is a men’s wallet or ladies purse! The seats are just wide enough for a small person’s hips, if you twist in your seat you end up knocking the person next to you with your elbow.The drop down trays are 6×6 inches. The seats DO NOT RECLINE AT ALL (all I need is for the seat to go back 1″ for me to prop my face to sleep to stop my head from rolling sideways). THE WORST THING is that there is no seat padding at all! My legs swelled up from my feet to my knees on a 6 hour flight and it took me 2 days for the swelling to go down. I have never had this problem with swelling on any other airline. At 11 pm a hour before landing, the crew turned up the lights to wake everyone up to push their credit cards for frequent miles for 20 minutes. I miss Southwest Airlines (they don’t fly to BVI).

    My parents just recently booked a flight with spirit to leave Thursday and return Sunday. They were going to El Salvador with a layover in Florida. When they arrived at the gate, on time, they were told that the flight was full and the earliest flight would be on Sunday. They were then given a spirit “credit” for half of what they paid after having to cancel their trip. They also had luggage checked in which they have no clue how they’re going to get back since they weren’t allowed to have someone pick it up in El Salvador. So now they’re out almost $1000.00 and luggage due to the flight being overbooked.

      The worst airline I have ever flown in my life. Deceptive and they charge extra 30 dollars even if you go over half of pound on your check in luggage. Carry on luggage price 55 dolllars. Really bad business never ever I will fly this airline.
