Skeeter Snacks settlementViewers of Top Class Actions say they are starting to receive checks in the mail from a Skeeter Snacks false advertising class action settlement.

According to comments and posts on the Top Class Actions Facebook page, checks began arriving on Dec. 21, reimbursing claimants for purchases of Skeeter Snacks Nut Free products that were allegedly mislabeled as being “all natural.”

Viewers say they received checks worth $3 each.

Plaintiff Mastane Shalikar filed this Skeeter Snacks class action lawsuit in 2016. Shalikar alleged that several Skeeter Snacks Nut Free products were falsely labeled as being “all natural” even though they allegedly contained artificial ingredients.

Shalikar argued that no reasonable consumer would consider a product “natural” if it contained ingredients like anhydrous dextrose, lecithin, soy lecithin, and cocoa processed with alkali. The plaintiff claimed defendant Skeeter Snacks LLC was in violation of California’s False Advertising Law, Unfair Competition Law, and the Consumer Legal Remedies Act.

By April 2017, the parties had reached a settlement agreement and submitted it to the court for preliminary approval. Under terms of the settlement, Class Members who submitted a proof of purchase could receive a full refund for every purchase of the covered Skeeter Snacks products made during the class period. Class Members who did not provide written proof of purchase could receive a total payment of $3.

The settlement Class included persons who purchased any of the covered Skeeter Snacks products at issue in the U.S. between July 1, 2013 and June 29, 2017.

More than a dozen varieties of Skeeter Snacks products were covered, including:

  • Chocolate Chip 8 oz.
  • Cinnamon Grahams 10 oz.
  • Chocolate Grahams 10 oz.
  • Chocolate Chip 36 ct. 1 oz.
  • Cinnamon Grahams 36 ct. 1 oz.
  • Chocolate Grahams 36 ct. 1.2 oz.
  • Cookie Variety 36 ct.
  • Chocolate Chip Family Pack 8 ct. 1 oz.
  • Graham Variety Family Pack 8 ct. 1 oz.
  • Chocolate Chip Minis 4/3 pack 8 oz.
  • Double Chocolate Minis 4/3 pack 8 oz.
  • Cookie Variety 4/3 pack 8 oz.
  • Honey Grahams 43 pack 10 oz.
  • Shortbread 8 oz.
  • Honey Graham 8 oz.
  • Double Chocolate 8 oz.

 

Skeeter Snacks also agreed to change the labeling on the covered products and on any future Skeeter Snacks products that contain anhydrous dextrose, lecithin, soy lecithin or cocoa processed with alkali. The company agreed to remove the term “all natural” from these products’ labels and from all other promotional materials.

The settlement also provides that Skeeter Snacks will cover class counsel’s attorneys’ fees and costs. Shalikar asked the court to approve an award of an incentive award not to exceed $1,500 for her service as class representative.

The court granted preliminary approval of the Skeeter Snacks class action settlement in June 2017. A final approval hearing was scheduled for Nov. 27.

The deadline for filing claims, objections, or requests for exclusion was Aug. 28, 2017.
