Sirius-XM-radioTop Class Actions viewers are reporting that they have received checks for up to $81.41 from the Sirius XM TCPA settlement over allegations that they received unwanted phone calls.

Several lawsuits hit Sirius XM over claims that new car owners received auto dialed marketing calls for the satellite radio service.

The cases were consolidated into a single class action that alleged Sirius XM used a third-party marketing company that used predictive dialing to contact consumers — a violation of the Telephone Consumer Protection Act.

In 2016, Sirius settled the class action lawsuit by agreeing to pay $35 million. In addition to estimated payments of $5 to $15 or three months of free satellite radio service, Sirius XM agreed to tell its advertisers to stop using auto dialers or predictive dialing systems to contact consumers via cell phone.

According to the Top Class Actions Facebook page, Class Members who filed valid claims for the Sirius XM TCPA class action settlement began receiving checks for as much as $81.41 starting Nov. 20, 2017. If you filed a valid claim for this settlement, keep an eye on your mailbox because checks are arriving.

Under the TCPA, companies cannot use automatic dialers to make marketing calls and/or send messages to consumers. The consumer protection law was enacted in 1991 to stem the aggressive marketing tactics companies were using to contact consumers via phone and fax. The law has been extended to help protect consumers from receiving advertising calls on their mobile devices without permission.

The TCPA also controls when companies can contact consumers with marketing messages and prohibits companies from contacting consumers on the National Do Not Call Registry. Companies who violate the TCPA can be subject to fines of up to $1,500 per violation.

Class Members include U.S. residents who received Sirius XM as a part of a promotion when they bought or leased a vehicle no later than Apr. 5, 2016, received calls on their cell phones marketing Sirius XM between Feb. 15, 2008 and July 5, 2016, and never paid for a Sirius subscription.

The award is estimated to be between $5 and $15, but the actual amount depended on the total number of Class Members who submit valid claims. The deadline to file a claim passed on Nov. 26, 2016.

    Today is 11/5/19 just received my postcard in mailbox, filed electronically on the website. Get calls all the time from Sirius and emails. Sometimes call me or my husbands number at 8 pm at night. So annoying, & even after the contract ended from ya purchasing the vehicles still would call.

    I received a postcard e notification of this lawsuit. I submitted a claim and still have closet card and still have my claim confirmation number. I never received anything and was suppose to. So where do I go from here. Start to think class action suits only help the attorneys involved with big fees and the people this suit was suppose to compensate are forgotten

    Didn’t know about this action, said it was sent possibly to junk mail or spam and I have to many to read and I probably deleted it.

    I haven’t received my check yet for the sirius settlement. How can I Check on this?

      I haven’t received mine neither, if you go to the website there are 2 options, a phone # to call and when you call that number, there is no way to speak with a person, its just automated and they a mailing address but there’s no guarantee they will reply and send you anything back,
