Nut Thins, Almond BreezeChecks have been sent to TCA readers from a class action settlement that alleged Blue Diamond Growers misled consumers into believing that Blue Diamond Almond Breeze and Nut Thins are “All Natural” or “Natural.”

According to comments and posts on the Top Class Actions Facebook page, Class Members who filed valid claims for the Blue Diamond Almond Breeze, Nut Thins class action settlement began receiving checks worth as much as $10 on July 17, 2017.

The class action plaintiffs alleged that Blue Diamond misled consumers into thinking their Almond Breeze and Nut Thins products were all natural, when they actually included synthetic ingredients. The plaintiffs also claimed that the products contained sugar, which was listed as “evaporated cane juice” on the products’ labeling.

Additionally, the class action lawsuit alleged it was misleading for Blue Diamond products to contain a symbol from the American Heart Association, the “heart check-mark,” on its packaging. The plaintiffs further claimed that Blue Diamond duped consumers into thinking Almond Breeze and Nut Thins contained significant amounts of almonds.

Under the terms of the settlement, Class Members could receive up to $20 depending on the number of products purchased and whether proof of purchase could be provided. Class Members without proof of purchase could receive up to $5 for either Almond Breeze or Nut Thins or both. Class Members with proof of purchase could receive up to $10 for either Almond Breeze or Nut Thins or both.

Class Members included anyone who purchased Blue Diamond Almond Breeze and/or Blue Diamond Nut Thins products in the United States from May 28, 2009 to Nov. 18, 2016. The product packaging must have included the statement “All Natural” or “Natural,” listed “evaporated cane juice” as an ingredient, contained an endorsement from the American Heart Association, and/or did not disclose the amount of almonds included in the product.

The deadline to file a claim for the Blue Diamond Almond Breeze, Nut Thins class action settlement passed on April 13, 2017.

An appeal to the settlement was filed, but was eventually withdrawn.

    Mine came in, we deposited it, and it got returned saying check was no valid. Has anyone else had this issue?

      Yes – and my bank charged me 12$ for the return fee, so this actually cost me money.
