Kraft Foods Group is facing a natural food label class action lawsuit, alleging the popular food product manufacturer purposefully mislabeled their Capri Sun juice brand as “all natural” when it contained synthetic ingredients.
This Capri Sun natural food label lawsuit was filed in mid-June by plaintiff Yuri Osborne, a resident of California, who claims Capri Sun juice products contain artificial ingredients that contradict the natural label.
According to the Capri Sun all natural food lawsuit, four of the Kraft Foods juice flavors, including apple, berry, fruit punch, and grape, contain citric acid or “natural flavor” as an ingredient. Citric acid is used as a preservative in hundreds of food products across the nation. This ingredient occurs naturally in fruit, though it is typically made for commercial purposes by fermenting glucose from corn or sugar beet.
The Capri Sun all natural label lawsuit claims that unless Kraft specifically uses non-GMO sugar beet or corn products, there exists a likelihood that these foods were genetically altered. Therefore the citric acid derived from them is not natural. The plaintiff states, “Simply put, the products are not ‘all natural’ because they contain unnatural ingredients.” The natural food label lawsuit further alleges Kraft labeled their Capri Sun juice products as all natural with the intent of misleading consumers to believe Capri Sun is a healthy juice option.
The Capri Sun lawsuit further claims “The market for all natural foods has grown rapidly in the past few years, a trend [Kraft] seeks to take advantage of through the subject false and misleading advertising.” Yuri seeks over $5 million in damages in addition to court costs, as well as Class certification for his proposed Capri Sun natural food class action lawsuit. This proposed Class would include consumers who purchased Capri Sun within the four years prior to the filing of this case.
The Capri Sun Natural Food Lawsuit is Case No. 3:15-cv-02653, in the U.S. District Court for the Northern District of California.
All Natural Foods Litigation
All natural class action lawsuits and natural foods class action lawsuits are becoming more common as consumers gain awareness of the false advertising and mislabeling practices that allegedly occur in the food industry in order to increase product sales. Consumers such as Yuri may choose to sue food manufacturers like Kraft Foods Group for the alleged natural food mislabeling, and demand transparency, honesty, and accountability from the food industry.
By filing a natural foods lawsuit or by joining an all natural class action lawsuit, consumers may be able to recover some or all of what they paid for foods they believed to be natural or all natural but actually contained additives, GMOs, or other forms of unnatural ingredients. I found something in my grandson Capri Sun drink this morning 7/1\2018 it looks like slime.
We often buy Capri Sun due to my son having ADHD and notice effects on him of non natural foods with dyes or other ingredients.
