Crate & Barrel class action settlementCrate & Barrel customers in California will receive merchandise certificates in the mail as part of a $3 million class action lawsuit settlement reached earlier this year.

A federal judge approved the Crate & Barrel ZIP code settlement on June 28, calling it “fair, reasonable, and adequate.” The settlement resolves a nearly two-year-old class action lawsuit claiming Crate & Barrel violated California law by asking customers to provide their ZIP codes during credit card transactions.

Barrel denied it violated the law and maintained it only asked for ZIP code information after the credit card transactions and not during them, and stopped the ZIP code policy in its California stores in February 2011.  The home decoration retailer agreed to the class action settlement, however, to resolve the litigation.

Class Members of the Crate & Barrel ZIP code settlement include all persons who:

purchased merchandise from a Crate & Barrel store in California between February 11, 2010 and February 11, 2011 and (1) used a credit card and (2) were asked to provide their ZIP code and had their ZIP code recorded. (“Statutory Claimants”)

purchased merchandise from a Crate & Barrel store in California between July 16, 2009 and February 10, 2011 and (1) used a credit card and (2) were asked to provide their ZIP code and had their ZIP code recorded. (“Common Law Claimants)

Statutory Claimants will receive a $5 merchandise certificate while Common Law Claimants will receive their choice of a certificate good toward $10 off merchandise or 20% off merchandise up to $200 in purchases.

There was no claim filing process for the Crate & Barrel class action settlement. All Class Members who did not exclude themselves by the May 29, 2013 deadline will automatically receive these merchandise certificates in the mail. The certificates were mailed beginning July 8, 2013.

The case is Shughrou v. Euromarket Designs Inc., Case No. 11-cv-02325, U.S. District Court for the Northern District of California.
