Nutella settlementConsumers who purchased Nutella chocolate-hazelnut spread are receiving checks in the mail from a class action lawsuit over false advertising allegations.

Viewers are reporting that checks worth approximately $5 have been mailed to Class Members who participated in the Nutella class action settlement.

The Nutella settlement checks are from two class action lawsuits (consolidated as In re: Ferrero Litigation and In re: Nutella Marketing and Sales Practices Litigation) that alleged Nutella was falsely advertised as a nutritious breakfast food. The plaintiffs argued Ferrero USA Inc. deceptively marketed, advertised and sold its Nutella chocolate-hazelnut spread as a healthy food even though it contains significant amounts of processed sugar and saturated fat.

Ferrero denied any wrongdoing but agreed to settle the Nutella class action lawsuits to avoid ongoing litigation.

Although the Nutella class action settlement was initially given preliminary approval in January 2012, the distribution of the settlement funds has been held up by objections and appeals. Over the summer, the 9th U.S. Circuit Court of Appeals rejected a challenge to the Nutella class action settlement. In September, the 3rd U.S. Circuit Court of Appeals upheld the nationwide Nutella class action settlement. The settlement website indicates that the distribution of payments would occur after all appellate rights were exhausted.

Class Members of the Nutella class action settlement include consumers who purchased Nutella in California between Aug. 1, 2009 and Jan. 23, 2012 or in any other state between Jan. 1, 2008 and Feb. 3, 2012. The deadline to file a claim passed on July 5, 2012.

Under the terms of the Nutella settlement, Class Members who submitted valid claims were eligible to receive up to $4 per jar of Nutella purchased during the Class Period, up to a total of $20 per household. However, the actual amount Class Members receive could be reduced based on the number of claims filed.
