Book publisher Macmillan has agreed to pay $20 million to settle state and consumer claims that it conspired with Apple Inc. and other U.S. publishers to fix the prices of electronic books. The class action lawsuit settlement comes nearly three months after Macmillan settled price-fixing and collusion claims with the Justice Department.
The Macmillan consumer e-book settlement agreement was revealed in an April 25th letter from the Texas attorney general to U.S. District Judge Denise L. Cote, who is presiding over the case In re: Electronic Books Antitrust Litigation.
The letter revealed Macmillan will pay $3 million in legal fees to the states that sued the publisher and $2.5 million to the lawyers who spearheaded the consumer class action lawsuit.
Three of the five publishers sued in the consumer e-book class action lawsuit — Hachette Book Group Inc., HarperCollins Publishers LLC and Simon & Schuster Inc. — have already settled. Macmillan marks the fourth class action settlement reached in the case.
The remaining defendant, Penguin, has not yet settled.
The Macmillan e-book class action settlement follows a February announcement from Macmillan that it had reached an agreement with the U.S. Justice Department to resolve price-fixing claims. The settlement was reached after a two-year investigation by the agency uncovered an alleged conspiracy between top U.S. publishers and Apple to set prices for e-books and limit the discounts retailers could give. Under the DOJ settlement, Macmillan agreed to immediately allow retailers to lower the prices consumers pay for Macmillan’s e-books.
