Welspun Fake Eqyptian Coton SheetsWelspun India Ltd. has misled consumers by selling inferior sheets at the price of premium Egyptian cotton, a new class action lawsuit brought by a Florida consumer says.

Plaintiff Ursula Keep says she purchased Welspun’s Perfect Touch California king sheet set that was advertised as “100% Egyptian Cotton” from Bed Bath & Beyond for a premium price.

Keep claims she relied on Welspun’s statements on the sheets when deciding to purchase them and had she known they were not 100 percent Egyptian cotton, she would not have purchased them.

Revelations regarding the fake Egyptian cotton sheets surfaced in August, when Target announced the results of an internal investigation into the quality of Welspun’s Egyptian cotton sheets. Target concluded that 750,000 sheets and pillowcases labeled as Egyptian cotton were actually made from another type of cotton.

According to the complaint, Welspun admitted the Egyptian cotton sheets were fake, stating “[w]ithout ambiguity the fault is on our side and so it is, let’s say, the error is from our side so I guess we have to take responsibility for it.”

The lawsuit brings five claims for alleged violations of Florida consumer protection laws, breach of express warranty, unjust enrichment, negligent misrepresentation, and fraudulent concealment.

“Defendants have engaged in unfair competition and unfair, unlawful or fraudulent business practices …by knowingly and intentionally concealing from Plaintiff and Class members the fact that their sheets were not 100% Egyptian cotton,” the Welspun class action lawsuit states.

Keep wants to represent a Class of all individuals who purchased sheets manufactured, distributed, or sold by Welspun as “100% Egyptian cotton,” asserting that consumers were injured as a result of overpaying for the fake Egyptian cotton sheets that Welspun misrepresented.

To date, at least three lawsuits filed against Welspun India Ltd. are seeking to be certified as class actions, with at least one separate lawsuit directed at Walmart, claiming Welspun fraudulently labeled its bed sheets as Egyptian cotton.

Another similar lawsuit against Bed Bath & Beyond over Welspun’s fake Egyptian cotton sheets was filed in Florida federal court in October by plaintiff Anais Elibrahim.

In November, following an independent audit of Welspun’s Perfect Touch and Crowning Touch sheets, Bath & Beyond announced that it could not guarantee that the fibers were actually Egyptian cotton and discontinued sales.

Target has cut ties and ended all of its $90 million in annual business with the Indian manufacturer in August, and Walmart stores stopped selling Welspun sheets that had been labeled 100 percent Egyptian cotton.

Target offered full refunds to customers who purchased the Welspun sheets between August 2014 and July 2016.

Keep is represented by Bruce D. Greenberg and Jeremy N. Nash of Lite DePalma Greenberg LLC; and Joseph G. Sauder, Matthew D. Schelkopf, and Joseph B. Kenney of McCuneWright LLP.

The Welspun Fake Egyptian Cotton Sheets Class Action Lawsuit is Ursula Keep v. Welspun India Ltd. and Welspun USA Inc., Case No. 1:16-cv-9133, in the U.S. District Court for the Southern District of New York.

I have had several sets of these sheets and learned today of this lawsuit when searching to purchase more. I love these sheets and would buy them again. I really don’t care they are not 100% eqyptian cotton, I love the feel and the no wrinkle resistance.

I previously purchase a king set of the Welspun sheets in 2012 from BBB. I bought them because they were the only sheets I could find that were wrinkle resistant. For that simple fact alone I was willing to pay the money for them. I have used them and have absolutely loved the luxury of them. They were everything that the label claimed them to be. Today while searching to purchase another set of Welspun sheets, I learned of this lawsuit. I must honestly say I’m disappointed that I can’t buy another set because of this lawsuit. In all honesty I couldn’t care less where the cotton was grown or harvested from. Egyptian cotton it nice, but I can honestly and truthfully say it’s not as nice as the cotton in the Welspun sheets. This set has been the most luxurious set of sheets I could find since American textile mills quit make luxurious mercerized cotton sheets because of overseas imports. They have been worth every bit the money I spent on them. We can sincerely thank Ms Keep now for the fact that alas we can now find no wrinkle free cotton sheets.
