Bed Bath & Beyond Inc. has been hit with a class action lawsuit accusing it of selling sheets that are deceptively labeled as being made of “100% Egyptian Cotton.”

Plaintiff A.E. claims that Bed Bath & Beyond manufactures, markets and distributes Damask 500 thread count “100% Egyptian Cotton” sheets.

According to the Bed Bath & Beyond class action lawsuit, these “100% Egyptian Cotton” claims are “false, deceptive, misleading and a violation of Florida Deceptive and Unfair Trade Practices Act (‘FDUPTA’)” because the sheets actually contain far less than 100% Egyptian cotton.

A.E. states that product testing indicates that the “100% Egyptian Cotton” sheets sold by Bed Bath & Beyond contained only six percent Egyptian cotton.

She asserts that the false representation on the product that the sheets contain 100 percent Egyptian cotton is likely to deceive consumers.

The Egyptian cotton class action lawsuit claims that Bed Bath & Beyond used the deceptive and misleading claims on its Egyptian cotton sheets in order to induce customers to purchase the product.

A.E. asserts that the retailer knew or should have known that the “100% Egyptian Cotton” claims were unsupported and were therefore false, deceptive or misleading.

The plaintiff claims that consumers relied on the “100% Egyptian Cotton” label when making the decision to purchase the sheets, and that they were willing to pay a premium for the sheets in order to obtain a product that consisted of 100% Egyptian cotton.

According to the Bed Bath & Beyond class action lawsuit, consumers who purchased the deceptively labeled sheets have suffered an economic loss because they did not receive the product they intended to purchase.

The Egyptian cotton class action lawsuit accuses Bed Bath & Beyond of violating FDUPTA “by engaging in the unconscionable, deceptive, unfair acts or practices” of labeling its products as consisting of “100% Egyptian Cotton” even though they actually contain far less Egyptian cotton than advertised.

By filing the Bed Bath & Beyond class action lawsuit, A.E. seeks to represent herself and a Class of Florida residents who purchased Damask 500 thread count 100% Egyptian cotton sheets since Nov. 1, 2012.

She is seeking injunctive relief, declaratory relief and actual damages. She also seeks statutory damages and reasonable attorneys’ fees and costs. She has demanded a trial by jury.

Bed Bath & Beyond is not the only retailer to take heat over Egyptian cotton sheets. In September, Target announced that it would be issuing refunds to customers who had purchased Welspun brand pillowcases and sheets that were falsely labeled as being made of Egyptian cotton but which were actually made of a different fiber.
