Walmart is a retail corporation with 8,970 locations and revenue of US$ 469 billion (FY 2013).Walmart has been selling linens that are falsely labeled as “100% Egyptian Cotton,” according to a new class action lawsuit.

Plaintiff Dorothy Monahan says Walmart sold bed linens manufactured by Welspun India Ltd. – a company that has purportedly earned a reputation for making textiles out of inferior and cheaper cotton and labeling them as “100% Egyptian Cotton.”

The allegedly mislabeled Welspun linens were sold under the brand names Canopy and Better Homes & Gardens, Monahan says.

Welspun admitted to the alleged mislabeling following an investigation by Target, according to Monahan. Target concluded that “Welspun substituted another type of non-Egyptian cotton when producing these bed linens between August 2014 and July 2016.” Following that investigation, Welspun admitted, “Without any ambiguity, the fault is on our side.”

Monahan says that investigation led Target to end its relationship with the textile manufacturer this past summer and the company voluntarily refunded customers who purchased fake Egyptian cotton bedding at their stores.

Walmart, however, had reason to question the fiber content as far back as 2008, Monahan says. But despite its suspicions, Walmart continued to sell the allegedly mislabeled Welspun products, she claims.

By marketing these mislabeled textiles as “100% Egyptian Cotton” Monahan says Walmart gets to charge a premium price for them that it couldn’t demand if the products weren’t so labeled. Consumers end up paying more than they should for a lower-quality product, she claims.

Walmart stopped selling the allegedly mislabeled linens in September 2016. Even then, Monahan says the retailer continued selling other Welspun products that weren’t labeled as containing Egyptian cotton.

Monahan reportedly bought a set of Better Homes & Gardens bed linens from a Walmart in Rochester Hills, Mich. She says the sheets were labeled as “100% Egyptian Cotton” and “Made in India.”

She says she relied on these representations when choosing to buy those particular sheets. Since she has sensitive skin, Monahan says she was willing to pay extra for sheets of a higher-quality cotton.

But the sheets she bought were among those Welspun products that contained lower-quality fibers and were falsely labeled as containing 100% Egyptian cotton, she alleges. As a result, she claims she paid more for the sheets than they were really worth.

Monahan is proposing to represent a plaintiff Class consisting of “[a]ll persons who purchased bed linens from Wal-Mart manufactured by Welspun and labeled ‘100% Egyptian Cotton.’” She expects Class Members meeting that description will number in the thousands.

She seeks an award of statutory and punitive damages, restitution, disgorgement of profits, and reimbursement of her court costs and attorneys’ fees.

    here’s my issue aside from walmart lying I have a few sets of these sheels they are horrible the sheets pill do not fit my bed they wrinkle and fade but after washing and use I am stuck with them like much of the lesser quality merchandise sold at a walmart. so I have learned my leason and shop elsewhere for linens but walmart needs to be held accountable for the deceit and failure to accept responsibility when selling products that are not what are advertised as
