mac class action settlementTop Class Actions readers are starting to receive gift cards from a class action settlement that accused MAC Cosmetics of violating state law by requesting customer ZIP codes during credit and debit card transactions.

According to reader comments and posts on the Top Class Actions Facebook page, Class Members who submitted a timely and valid claim for the MAC class action settlement began receiving store gift cards worth as much as $34.10 on May 18, 2016.

The MAC class action settlement resolves allegations that cosmetic company violated Massachusetts’ Unfair Trade Practices Act by asking for (and then recording) customers’ personal information, including ZIP codes, during the point of sale.

MAC continues to deny that they violated state law but agreed to the terms of the settlement to avoid the cost and expense of further litigation.

According to lead plaintiff Lauren Miller, MAC employees routinely asked for ZIP Codes of customers acting like it was a necessary part of completing a debit or credit card transaction. However, Miller claimed that the personal information was collected, along with the customer’s name, in order to be able to send marketing material to home addresses.

Class Members of the MAC settlement include customers who bought items from a Massachusetts retail store between Nov. 5, 2009 and Oct. 9, 2015. During the sale, Class Members must have been asked by a MAC employee for their ZIP code in conjunction with a debit or credit card transaction.

The deadline to file a claim for the MAC class action settlement passed on Apr. 1, 2016.

    I a ten dollar gift card that expired and I had no idea it had an expiratdate. This lawsuit has to go with giving out and selling my imformation to teller Marketers. I’m so pissed what scam. I went to re deem and they said it expired.

    Called MAC asking where in NJ it was ok to use the card, they sent me forty minutes to a store they said would and that store wouldn’t. Called again for another location and ditto. I’m afraid no place will take it even the so called MAC ‘FREE STANDING’ locations. Like one person said: nice job MAC lawyers!!!

    The downside of this suit is the gift cards can ONLY be used at MAC stores. This excludes any MAC locations within department stores. I reside WI and purchase at a MAC location within Macys. The nearest MAC location is NY. Therefore this suit is somewhat a scam as MAC will ultmately hold funds from all the gift cards that were unable to be redeemed/used. Those affected with the factors controlling redemption should have been given a check vs the gift card. Well played MAC attorneys!
